    Should any user have an offer that they would normally have rejected that is dated before Thursday, please write back and accept the offer in part payment and without prejudice and that you will be continuing your claim for the remainder once this test case has been held. Make sure your case has not been closed.

    My guess is that the Courts are likely to uphold their decision to keep current cases on hold until the test case ruling results are known.
    I can't see the Test Case happening any time soon either. Those of us unfortunately stuck in the Court system will have an extremely long wait for our money - if indeed we get any back.

    FrugalPam- you do know that if they apply to have your case set aside(or placed on hold) until the test case occurs that you can apply to the judge for the case to continue on. It will be at the judges' discretion. And while the case is on hold, you are earning 8% s.69 interest on top. A nice savings account for when the banks will lose. YES I AM A BELIEVER.
  • TO be honest, frugalpam, there is lots and lots of discussions with regards to the case and so unless the Master of Rolls decides to put to general hold on cases then the advice is business as usual. Sooooo look into grounds to get a potential set aside overturned until such time as you are unable to do so.
    It is frustrating but have you got any storecards who have charged you? Have you got any credit cards that have charged you? These ones are fair game at the moment and are excluded from the test case. There is still a way of doing things in the meantime. Tom Brennan Case against NatWest will be decided on Monday as well, so that will go to appeal either way. SHould be interesting as well.

    As some people are stating that upon contacting their local courts, they have no knowledge of cases being "frozen", is it too late to submit a claim through the courts. I am about 6 weeks into my 8week wait with Natwest and RBS.

    if any one has access to downloads have a look for a documentary called Maxed out, im prety sure theres a lot of clips on youtube as well.

    its a USA documentary about there banking and credit card companies, and baring in mind banks operate prety much the same the world over, its a real eye opener.
    one card company was sued for bining cheques so they could claim they were not recieved and slap a late payment fee on people accounts.

    its well worth a watch.

    phone them and they will let you know if there is an offer on its way or wether they have put your complaint on hold, if they have chosen to put your claim on hold its doesnt stop you proceeding to the court action stage, and like a few people have said, untill the courts say other wise its business as usual.

    dont let rescent events put you off, the banks would love nothing more, it only suprises me that there not dealing with claims and making very low offers in the hope people will accept it rather than risk loosing out totaly, cos there is pleanty of people panicing on this web site since it traspired there would be a test case.
  • The answer, is you can sue the bank if they fail to respond within your timescale. There is two choice you have, lose charges because of the Statute of Limitations or sue the bank and the case maybe stayed until the banks case is dealt with which could take years.
