Dear all - don't give up.

I claimed a few months back - got a holding letter, then last week it happened.

Long, waffly letter stating how they believe the fees are fair and everyone has plenty of opportunity to ask if help etc. They also enclosed a few leaflets "for my future information" about fees and complaints procedure. All this went on for 1 page and I was beginning to gice up, but turn over and you find:
"however, having reviewed your case, and without admitting fault we'd like to offer you a settlement of £874"

This was the full amount claimed - should get it in 14 days .
=========

I've just got off the phone with Natwest who told me that that my claim was paid in yesterday but my account has been closed (due to it going o'd during the claim process) and it will take "upto 6 weeks" to get a cheque out to me.

I wondered if:
• anyone has actually had to wait this long;
• Would I be able to claim any interest at having to wait;
• Can they actually withdraw banking facilities like this?
Am fortunate that I've switched myu main bank account now but this seems a tad underhand?

All comments greatly recieved

Alex

I'd like to thank, onoce again, the people on this site and fora. Keep at it - you'll all be ok.

• I think people should still continue on with their claims and then file at court because when the bank does attempt to ask that the case be put on hold, you can also apply to deny the motion and it would be up the the individual jusdge to decide. If he does put it on hold, think about the 8% s.69 interest that will be adding up. Nice.

Do people really feel certain that the test cases will show that the bank charges are illegal/unlawful, and that we'll get our money back eventually?
I have FINALLY got a Court date for late September and it would now appear it is likely to be stayed :mad: Natwest have been procratinating over my claim since Feb/March, and I feel incredibly despondent about it all. I just have this feeling I'm not going to see my charges refunded.
I wish I'd claimed via the Ombudsman way back then, and I wouldn't be in this situation. I'm just incredibly angry about the whole affair.

Hi

My first post here - can some one help me out. Natwest received my request for a refund on 7th June and therefore I have now been waiting for 7 weeks. Yesteday I received the following email from them:

Dear Mrs *******<o></o>
<o></o>
Thank you for your further e-mail.<o></o><o></o>
I advise that your claim has now been verified and an offer letter has been prepared which you should receive within the next ten working days<o></o>>

<o></o>
This was sent on the day of the OFT ruling at 1530 and says my claim has ben verified and an offer letter has been prepared - will this count the same as them making an offer and therefore likely go through???

It should do, print out your email and copy it a couple of times just incase you need to send it in to verify your offer.

I would email them back and say thank you for your email and I look forward to receiving this by "such and such date".

Generally NatWest will give you an offer of pretty near your claim and so you would probably do well to accept it at this time.
• NatWest will honour all offers that they have sent out which they have stated on their website. FrugalPam- you do know that if they apply to have your case set aside(or placed on hold) until the test case occurs that you can apply to the judge for the case to continue on. It will be at the judges' discretion. And while the case is on hold, you are earning 8% s.69 interest on top. A nice savings account for when the banks will lose. YES I AM A BELIEVER.

got my offer letter yesterday for the full amount i was asking £4398.00, i signed it and sent it back by recorded delivery so i am hoping they are going to honour it like they say on their website
• They will, their website already states that offers already sent out will be honoured.

You're lucky - well done. I'm claiming a quarter of that amount, and yet they've filed a defence with the Courts and my case will now no doubt be stayed and heaven knows when I'll see my money (if ever) I can't help but be questioning the point of making claims against banks any more.
I really should have gone via the FO back in March instead of getting drawn in to the gung ho of taking it to Court. I won't be drawn into that again :mad:

I just got off the phone to natwest, and theres no letter in the post with an offer so im now on hold, LOL. fortunalty im already on with the court proceedings so hopefully they will still go ahead.

not to bothered tho, the money was needed at the time they hit me with the penalty charges, and it would be handy right now, but life rolls on and theres every chance that by the time i get a payout ill be in a better position financialy and wont need it so bad, it would then be a much sweeter payout as far as im concerned, especialy with that 8% interest. hehe:rotfl:
