Okay, folks, I can answer my own post. After spending a few hours trawling the CAG site, I found some incredibly useful information, though it was hidden amongst the threads for Abbey National!

I hope that others of you might find this useful too:

    http://www.consumeractiongroup.co.uk/forum/abbey-bank/57385-examples-witness-statements-disclosure.html#post479224

But now, I've discovered that I might have anojther problem. As a self-employed person, my account is a business account, and the new Consumer Wiki says:

Having got this far, the advice I now need is whether I have just been wasting my time, because I sent my initial letters quoting the 1999 Act as well, though neither NatWest, Cobbetts or anyone seems to have mentioned this yet.

They wont notice either mate, they dont communicate, I think Natwest just say hey Cobblers, here is a letter can you deal with it please. This is up to you but if you are prepared to accept your charges & your MCOL fee & not the interest, send Cobblers a letter & see what they say, its likely you wont get a reply so do what I did & ring after 7 days then keep ringing until they settle, I did :D

    Hi All.

I had a Natwest current account and a Natwest credit card. I have been writing to them separately to recover charges. Both have reached the court stage. Can I make one claim for a total amount or do I need to file 2 separate actions. Surely Natwest Bank is responsible for both.
    <O:p
    Cheers

    Ed.

I would continue to do it seperately, its likely this could cause confusion at an important stage. I also think they will make you an offer, Natwest do make offers but it is right at the end of the 8 weeks, choice is yours though :)

I have been made an offer from natwest but have been told no letter has been sent out. (over a week now) I have also recieved a defence from cobbetts the natwest lawers planning to strike out the case. Are natwest just holding out or are they wrong not to send out the letter after making the offer. PLEASE HELP

Ring them up & tell them you will continue with court proceedings until you receive the letter from them, Id also get the persons name you speak to for future ref. I will say though that it is likely that the offer you get from them will be charges only & not interest or your MCOL fee. Once you get the offer, ring Cobblers & negotiate with them, I did.

  • Hi All,

Hoping you might offer a few opinions....

I'm trying to claim a refund for charges from Natwest. I wrote to them some time ago and made my claim inclusive of compound interest as this drastically increased the amount being claimed.

The bank have offered to make a "good will gesture" of basically the amount my charges totalled but without any interest whatsoever.

What do you think? Should I accept the offer and not push my luck?? Any advice or feedback from people in a simillar situation or otherwise would be appreciated.

    Thanks,
    Adam
  • Hi

I have asked Natwest for a reclaim of my charges with intrest.
I got back a letter today stating that they are looking into it but will take 6 - 7 weeks. I have already sent a complete list of dates and charges which were attched to the request letter.

I feel this is delaying tactics on NatWest part. What do I do now ????

    Thanks

This is quite normal for natwest.

I sent my first letter just under 7 weeks ago and got my offer letter yesterday offering the full amount i asked for (charges less interest).

They will only ever pay your charges, never any interest unless you win in court.

It seems at the moment that it is taking longer if you take it through court than if you wait.

If you don't mind waiting then sit it out and they will pay up in the end.

It depends on how much you want the interest.

As far as i am aware you only ever get the interest back if you go down the court route.

Hi,as far as i'm aware i think you have to accept their offer if it's for the full amount of charges, you would only get the interest back if you went to court. If you went to court it would take quite a bit longer, but if you send your offer letter back now(signed),then you would have your money next week.Goodluck:money:

Hi,Natwest are offering round about the full amount of charges without any interest at around about the 7th-8th week,so really it's upto you whether you want to wait(we waited and received nearly 4k from rbos, same group as natwest).Goodluck

I am claiming charges against natwest for £4600. Today i recieved a letter from my local court newcastle with a date for 8th October. The court has ordered that the allocation questionnairs be dispenced and the allocation fee of £100 to be paid by me the claiment. Does this mean that i dont need to fill in an allocation questionnaire and how or where do i pay the allocation fee. Help please:confused:
