    JB, if you are able to get to a local branch I would go in personally & tell them you want them to refund the charges as for 52p that is a joke. Take a cheque for a tenner & if they refuse to refund them tell them you want your statements for however long you think you have been charged.

    I am requesting details of a closed account and a closed credit card from NatWest... do I send them £10 in total or £10 for each account?

  • I haven't posted in a while, as the court system has taken its course and I have now finally been sent a court date for my claim against NatWest: 26th September.

    It tells me that "This Claim is allocated to the Small Claims Track and the parties are referred to Part 27 of the Civil Procedure Rules and the Practice Direction of that Part for guidance on how the hearing of the claim will be directed."

    The Order I have been sent by Brighton County Court includes the following Directions:

    6) The Claimant do by 27th July 2007 file and serve details of how the sum claimed is calculated.

    7) Disclosure of documents shall be dealt with as follows:
    a) Both parties shall give each other standard disclosure by list, the lists to be served by 4pm fourteen days before the hearing
    b) Any request for a copy, or inspection, of any document shall be complied with by 4pm seven days before the hearing.

    8) The original documents must be brought to the hearing.

    9) the judge may refuse to consider a document or take it into account if a copy of it has not been sent to all parties as required by this Order.

    10) The documents to be sent to the parties and the court must include the statements of all witnesses (including the parties themselves).

    11) Witness statements must:
    a) Start with the name of the case and the claim number;
    b) State the full name and address of the witness;
    c) Set out the witness's evidence clearly in numbered paragraphs;
    d) End with this paragraph: 'I believe that the facts stated in this witness statement are true.'; and
    e) be signed by the witness and dated.

    12) The judge may refuse to hear the evidence, or consider any statement, of any witness whose statement has not been prepared and copied to all parties and the court in accordance with the paragraphs above.

    13) Neither party may rely on any report from an expert at the hearing unless permission has been granted by the court beforehand. Anyone wishing to rely on an expert must write to the court immediately on receipt of this Order and seek permission, giving an explanation why the assistance of an expert is necessary.

    14) Because this Order has been made by the Court without considering representations from the parties, the parties have the right to apply to have the order set aside, varied or stayed. A party wishing to make an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this Order.

    Okay, I could do with some advice here, or could someone point me at specific posts where the following matters have been addressed.

    A) Their paragraph 6 seems obvious -- just re-submit (yet again) all the statements and calculations that I've made previously in the correspondence with NatWest, Cobbetts and so on.

    B) In paragraph 7, precisely what is "....standard disclosure by list", and how should that list be presented ?

    C) Witness statements? I'm the only witness! I found another post on the forum that, obviously incorrectly, said that this was just a list of witnesses! Since this is obvioously critical, is there an existing template for a witness statement?

    Since this is now very urgent, any advice will be much appreciated. I've been cool as a cucumber up to this point, but for the first time, I'm feeling nervous.

    Incidentally, I tried calling NatWest today (completely stonewalled me, said they refuse to negotiate with me further now that I'm going to court) and Cobbetts, who were pleasant enough, but admitted that they were snowed under, and would have to refer back to NatWest before they could make me a better offer than the one sent to me at the beginning of May. So, catch 22, then!

  • Okay, folks, I can answer my own post. After spending a few hours trawling the CAG site, I found some incredibly useful information, though it was hidden amongst the threads for Abbey National!

    But now, I've discovered that I might have anojther problem. As a self-employed person, my account is a business account, and the new Consumer Wiki says:
    ...you need to rely on the Common law of contract and the Unfair (Contracts) Terms Act 1977 rather than the 1999 Unfair Terms in Consumer Contracts Regulations, because these deal with business to consumer rather than business to business relationships.
    Having got this far, the advice I now need is whether I have just been wasting my time, because I sent my initial letters quoting the 1999 Act as well, though neither NatWest, Cobbetts or anyone seems to have mentioned this yet.

    I had a Natwest current account and a Natwest credit card. I have been writing to them separately to recover charges. Both have reached the court stage. Can I make one claim for a total amount or do I need to file 2 separate actions. Surely Natwest Bank is responsible for both.

    Just wanted to thank everyone on this thread who has posted advice, i have sucessfully claimed back 1731 pound from natwest and have followed advice and information from here which kept me going, even though after waiting 8 weeks i rang natwest and they had no record of my claim. However i read postings on this thread which inspired me to keep going.

  • I have been made an offer from natwest but have been told no letter has been sent out. (over a week now) I have also recieved a defence from cobbetts the natwest lawers planning to strike out the case. Are natwest just holding out or are they wrong not to send out the letter after making the offer. PLEASE HELP
