Cheers ripski - I'm just sick of it. I wouldn't mind if I was claiming thousands of pounds, but it's less than £1000 !!! I don't know why they're being so b!oody minded with my case. I helped a girl at work claim her charges through MCOL and she's been paid up in full - and started her claim weeks after me - and she lives in the same County. She just received a cheque for around £4800. I'm thrilled for her, I truly am, and wish I knew why they are holding out on me.
I would NEVER go through the stress of taking a bank to court ever again. It is now making me feel ill.
PamPam dont get despondent. I know it is easy for others to talk. I am not sure it is the court rather than just 'sod's law ' Some seem to get paid out so much quicker
Has any one else got advice for you surely there is something to hurry Nat West up.0 -
Hi pam,
We're in the same boat, I've been claiming on behalf of my DH since 22nd Jan 07 and our court date is 6th Aug, i also posted asking why some people seem to just send off the letters and the banks lay down and roll over and give them back the money just like that. There seems to be no consistancy to why some people wait months and end up going to court and others (and it doesn't matter how much you are claiming) get their money without much fuss.
if i can be of any help let me know:money:0 -

Hi there
I'm in exactly the same boat as you are, I started my claim back in February and feel almost seven months down the line no further forward, it is demoralising and like you, had I known how much stress and anxiety this would cause would never of gone down the Court route.
In my case I was delayed (my own silly fault) for not quoting the correct Statutes in my original Particulars of Claim - this caused a delay whilst I had this re-amended through my local Court (additional cost of £35) - that was bad enough but the Court office was eight weeks behind on their paperwork and so it sat on a desk gathering dust for two months with nothing happening - waiting for the Court to reserve my new Particulars! Frustrating, even though it amounted to one line of text missing from my original claim.
That said, I'm now awaiting for Cobbetts to no doubt re-file a second defence... (their original defence played on lack of particularity, which has now been addressed but I'm expecting them to pull another reason out of the bag!) then go through the process of awaiting a Court date. I just keep hoping it will be worth it in the end and that one day we can all register our successes on this page!
I was made redundant last month (along with a third of the Company), and my company can't even pay my Statutory redundancy pay and notice pay, so you can imagine how this money would make a huge difference. I'm determined not to give up. I was a customer with Natwest for 13 years and they made my life hell, until I finally closed the account two years ago. Funny but since then I've never incurred a single penny of charges with my new account!
Good luck, hope you get your rightly deserved money back soon!

I sent my first letter to Natwest and had no reply, so i sent my second letter to Natwest telling them i would be taking the matter to court if i did not hear from them in 14 days. When i arrived home from holiday there was a letter from them saying they are investigating my claim and they should be able to reply within 6-7 weeks! Do i continue with the court proceedings or sit it out and wait 6-7 weeks?
Has anyone else had the same response?
Any help would be most appreciated.

Hi Jen - thanks so much for posting and relating your experience with Nastywest. I was beginning to feel I was the only one being kept waiting like this and felt very down about it all yesterday. I'm sorry to hear about the redundancy - I had the threat of that hanging over me until last week, so I can imagine how you're feeling. I'm sure we'll each get our money, but we've been the unlucky ones who are facing a long wait
For different reasons, I could really do with that cash myself at the moment (horrendously expensive and unexpected repair bill)
Well - I've got this far and I'm not giving up now. I shan't be settling for a penny less than the amount I've claimed! If you need a bit of moral support, just let me know!
I've been absent from the bank threads for too long - I used to spend a lot of time here cheering people on and offering advice where I could. I let myself get diverted by other things. However, I'm back again
all the best,

Those of you who are still awaiting for a court date, keep strong, I know the process may seem to be dragging along, but s.69 interest daily adds more to the amount that the bank have to pay out in the end. They will pay out.0

From all that I've read, Natwest do refund charges if you give them the time they suggest. Whether or not to go to Court..... it depends on how much you want to reclaim the interest and possibly a long wait.
My claim has been going on since Feb and I'm now stuck in the Court system and it is STRESSFUL.
The Court route isn't for everyone.
