After a little worry when NatWest said they were going to defend their claim I got a letter this morning saying something along the lines of "we did nowt wrong guv'nor but we're giving you what you asked for 'cos we can't be bothered defending, PS, we still did nothing wrong, 'onist" - or words to that effect.

fair enough, they paid up with interest, not a massive amount of cash but it clears my present overdraft and pays for a couple of bottles of wine.

    cheers natwest.

    double cheers MSE!

    Morning All,

Just asking some advice please reference my thread. I have looked through the threads, but the Natewest are really confusing me. I am thinking of MCOL but just a bit nervous given the banks attitude.

Robbie, Natwest dont like to offer any more than the charges alone, was the figure you requested inclusive of interest? If so then how much was the charges only? You could contact the FO & ask them to look into it but they wont award you interest, only the courts do that.

I have been waiting for ages for a court date from Natwest finally got one the other day for 4th October, defence was entered in May!!

Although I have an update which I will post shortly

    Thanks,

The difference is part interest - total interest is about £700 so its still £300 short of normal charges.

What is the procedure for the ombudsman? Is that before court then?

    Cheers

Sorry Robbie didnt see this post, Id take it mate, I appreciate your thinking well they owe me £300 but what you have to do is look on it as a bonus that you never thought you would see the money again..

Choice is yours tho mate :)

To cut a long story short Natwest defended my claim back in May, I got an offer amounting to my charges only a week after they entered their defence, I rang but they wouldnt negotiate on the £120 MCOL fee & since then I have left it until I go the defence from Cobblers, when I got this defence I replied to them (Cobblers) saying, ok forget the £200 interest, pay me my charges & the £120 MCOL fee that I have now paid since the offer & we can call it quits!

I didnt get a reply so I rang them up & asked if they had got my letter, eventually I got someone who had read it, they asked for my charges to b sent again so I emailed them across & they basically did what I asked, charges + £120 MCOL, said they would send a cheque within 2 working days, we shall see & I will let you know Wednesday if it has arrived!

So if like me you arent too concerned about interest then even the solicitors will negotiate!!

:( Have I dropped a boo boo, i,ve recently recieved a defence from cobbetts solicitors and request for further information and that they have filed a copy with the court. At the back they have asked the request is served pursuant to CPR part 18 with regard to rule 27. They have request a response to this by the 17th of july. I haven't recieved anything from the courts requesting futher information this came from their solicitors. My fault i didn't read all of what they sent me  have i blown my chances or is there anything i could do. I was just about to contact them and accept their offer if they could agree to pay me the court fee. Any help please!

I've just phoned natwest up to ask for my statments and the guy just said he ordered all statements for both my accounts and will be with me in 7-14 working days. No charges for it either.

He did say it will be FULL statments, not just the charges. Is this right?

In the mean time im going to draft the letter so i can send it ASAP.

I will update this topic as i go through the process.
