  • Recieved a atter this morning dated 22 july othering me £612 out of £804 without any court interaction. I was more then suprised to recive it condering the recent OFT announcement. Should I accept it?

    For some reason I'm really worried they are going to take my overdaft away as they have suggested it will be paid into my account if acceped. My over daft is ^59 abd will leave me with no money again Can natwest do this and are they know to do this> Thanks.

    Thanks for that Pam - still haven't heard off them so I can't see a letter they stated they sent on 24th now arriving. Also had a further email off them stating claims will only be honoured where an offer has been received.

    Where do I go now???

    Should I go down the court route and use the emails as a belief that I was actually made an offer or do you think the FO would look at this due to the emails that I have.

    Hiya
    It's a tricky one, as you haven't actually got an offer letter in your hands, yet you've had an email saying a letter was one it's way. This is soooo typical of Natwest :mad: As things stand though, your claim is registered with them, so eventually you may well get your money back, depending on the outcome of the test case.

    I'd be tempted to go down the Court route to show them that you mean business - I don't think the FO are taking on any more cases at the mo, pending the test case situation.

    Edinburghlass may have some better suggestions to offer - hope that what I've said isn't as clear as mud :o

    I've heard back from Cobbets. With the hearing 2 days away they are requesting a stay from the courts due to the OFT's legal action. If they do not get it before the hearing they will apply for it at the hearing.

    Where do i stand on this now? I thought i was nearing the end of this matter but it seems like it may just be the start!

    From what I've read on here, you can contest that and ask the judge for the case to continue - I'm not sure exactly how that works, but someone more knowledgeable will probably come along and explain it better than I can.
    Also, the judge may rule against their application for a stay.

    Nil desperandum (says she, who was in the pits a few days ago :o )
    - maybe ring the Court to find out whether Cobbets have been in contact with them? It might even be bluff on their part.

  • Not sure if Martin Lewis has an application for removal of a stay on his site but Stephen Hone's penalty charges site does.
    I have not worked for NatWest Bank since February 2009

    Thanks for that. I did contact the court before i heard from Cobbetts and they hadn't had any contact. Cobbetts did say if they don't get the stay before the date they will attend and for a stay then. Matter of wait and see i guess.

    I haven't posted on one of these forum things before, but here goes:

    I'm in the process of trying to reclaim my charges from the ever difficut Natwest!!! This has been going on since Jan 07 I sent them my original letter waited 8 weeks to March 07 only for them to say they never received my letter. So I re-sent it and waited 8 weeks and heard nothing so sent a letter chasing in May 07, they then made me an offer and said that they had sent me a letter detailing the offer which I have still not received I have sent other letters chasing them and threatened to go to court, I've phoned them weekly and they have supposedly sent me duplicate letters which I have not received!!!!!!

    So I decided to contact the Financial Ombudsman and that was last month but they have a back log and have not got back to me yet, but in light of the OFT test case they are not likely to, as they are placing cases "on hold".

    What I really want to know is, now from having read the articles on here, whether I can still accept the offer Natwest have made despite the fact they have never sent the letter and the offer is usually valid for 2 months from the date of the letter????????

    I can't seem to get them to send me the letter, and so I am getting nowhere fast on this one!!!!!!!!!!!

    Anyone got any ideas or know of a way to make them co-operate??????

    Got a cheque for £1,762 from Cobbetts on behalf of Natwest today. I'm claiming £1,780 plus £280 interest plus £120 court costs. Along with the cheque was a cancellation form for the court process (I have a hearing on 20th Sept) and I have to agree not to disclose information to a 3rd party.

    Can I still bank the cheque, say thank-you for the part payment and carry on through the courts for the rest (not too botheres about the interest but would like my court fee back as this could have been settled some time ago)

    Just not sure where I stand in terms of legality of banking the cheque and telling them to stick the confidentiality etc up their backsides!!

    Any help much appreciated!!

    Put it this way if you don't accept the offer they won't make it again and you will need to start court action and risk having your case stayed. They will pay any monies reclaimed into the account they were claimed from which will of course reduce your overdraft.
