  • Hi buudy9 I just wanted to give you an update on our story, primarily in case it helps others in the future. We did go back and discuss the requirement for a Bond of Caution with the solicitors who handled the dative application and although we did initially get some advice that flipped back and forth, in the end we were told it would not apply as there was a will, so we went ahead with the application just before Christmas, and today, exactly 7 weeks to the day Glasgow SC called to take payment and confirm confirmation has been granted based on the submission details mentioned previously. Massive weight off our shoulders and still work to be done, but once again thanks to all on here for guidance and help, more than anything else I know my wife will always be able to look back with pride and contentment knowing she was able to do this one last task for her dad, in a dignified and respectful manner fitting to his memory, thanks again.

    To briefly summarise for the benefit of any readers:

    • Deceased left a will.
    • Nominated executor predeceased 
    • Executor dative appointed.
    • Confirmation granted without a Bond of Caution.  (On the face of things, Bond of Caution rule was relaxed by the court).

  • Hi Im new to this forum but it looks really useful. Can anyone send me redacted copies of successful completed C1 (2022) forms, so that I might figure out how to complete this form following my mothers recent passing?

    There are a reasonable number of examples available on the forum including in this thread and on other threads such as https://forums.moneysavingexpert.com/discussion/6343501/c1-scotland-inventory

    You might need to do a bit of searching.

    My late mothers excepted estate has received Confirmation from Glasgow Sherrif Court at the first attempt. This was totally due to the information and help on this forum especially from buddy9.
    I have gone through the C1 and anonymised it by changing names, addresses, account numbers etc. Everything else is exactly as the original. If anyone would like a pdf please send me a private message including your email address.

  • Lodged today at Edinburgh with a little feedback, which was able to be amended at the counter. Two that were notable for the future. 

    1. One of the life insurance policies had an English address.   I was advised to change that to their Scottish office address.  If no Scottish office, it would be classed as an estate in England.  
    2. Cars had to be listed with the Make and Registration and Value on separate lines

    Turned up in person at Greenock Sheriff Court yesterday to submit documents, and got the phone call to confirm all was in order and to pay this afternoon. Will receive certificates next week.

    Many thanks to all that helped, and in particular to @buddy9 without whose help getting a first time acceptance would have been very difficult.

    For context we had been quoted (by my Mum's solicitors) between £25,000 and £35,000 + VAT to administer the estate!

    To anyone reading this and wondering whether to DIY - yes, there is a whole load to learn but it does all become clearer and more familiar with time. Whilst large, my mum's estate was uncomplicated with no property involved although IHT was payable.  I would encourage anyone to seriously consider the DIY route if you are prepared to be patient, do the research ( including reading ALL of this thread) and posting questions on this thread where clarification is needed.

    Thanks to the forum, especially buddy9, I've successfully obtained Confirmation from Inverness Sheriff Court.  Documents lodged in person 4/03/25, Confirmation received in the post 12/03/25!  Just had a couple of minor errors that were dealt with via email - these arose from 'estate elsewhere' (i.e. assets outside the UK), which had to be excluded from the figures, with separate totals for the UK 'estate for Confirmation'.  Having achieved such a stunning turnaround, I can only reflect that the C1 help notes are hopelessly inadequate, and, whilst I appreciate that they can't be expected to cover all possible scenarios, could easily be improved.  I did take a lot of time searching through the MSE forums, and picked up a lot of points that, ultimately, have probably led to the fast processing (though I'll never know which ones in particular).  From my experience, a solicitor need only be used for estates of great complexity or with unusual assets, provided the applicant has enough time to trawl the internet.  It should not be like this.  Once again, thanks to all, and buddy9 in particular.

    @bloodygoodbloke - have you heard anything back from Edinburgh sheriff court yet?

    I resubmitted my corrected C1 on Monday 4th Feb and still waiting for their call 😣
    The chap behind the counter told me verbally it would be 2-3 weeks as they were "cracking on" so I'm not sure if I shouldn't try to call them to see if there is a problem
    Have been jumping on my phone every time it rings over the last 2 weeks. Just need them to get on and either call or send it back again
