Everypennysaprisoner said:Thanks buddy9. So I submit the C4(S) form back to the court, then when I get the additional certificate for the care home, I send them that to claim the refund? Is there an additional cost for submitting the C4s form do you know?0

Thank you so much. I'm currently filling out the form.0

Had a phone call from the sheriff court because I need to do a couple of amendments to the C4(s) form, to add an asset after the confirmation has been granted. Can anyone please give me advice on what is written in this part?0

Here is an example of a C4S declaration page that might help you spot the changes needed

Can i ask if the gross value of the estate for inheritance tax ( box 23) should be the same figure as the net value of the estate for confirmation ( box 15) . Ie are funeral expenses taken off for box 230

Box 23 should not equal box 15.
Box 23 - In many cases this will be the same as the gross value for confirmation (box 11). But where, for example, there are items such as non-exempt gifts, or property which passes by survivorship, this total will be greater than box 11.
Box 24 - This is the box 23 value minus funeral costs and liabilities. Where box 11 equals box 23, box 24 is likely to be the same as box 15.
Box 25 - From the value in box 24, subtract the amount of estate that passes to the spouse or to charity. Where the spouse inherits everything, the NQV will be zero.

Thank you so much , that is very helpful .
My mums estate is very straightforward hence I am attempting the form myself but was not sure of that bit . Might have more questions before I finally submit it .

Is it ok putting DWP state pension due at time of death , Income tax rebate due and SPPA pension due all under Moveable Estate in Scotland or should any of these go
under personal estate in England and Wales instead or does it not matter ?Assuming SPPA would be Scotland but unsure re income tax and state pension .
Also, for these items is it ok to just put
DWP state pension owed
Income tax rebate owed
SPPA pension owed on the Inventory description or do they require more details like addresses.
I may add that these amounts are each under £300.0 -
SPPA pension under payment would be moveable in Scotland.
Best to list income tax refund and state pension underpayment as personal estate in England and Wales.
Should only need brief detail in the inventory.
