Would you like to say which court?
  • Thank you @buddy9.

Re the potential GWR, exemption potentially applies on the grounds that he was very infirm and we were providing for him (IHTM 14342).  Also, I could perhaps could get round more paperwork by simply including 100% of the value in the house on the confirmation? - the value of the whole estate would still be well under £200k.

I think that you should only include the owned half share in the inventory. Otherwise it is your decision.
  • Thank you @buddy9. I really value your input.

I will stick to the original plan and include only the half share of the property in the inventory.  I can include the other half share in the figures at boxes 23,24, and 25. I've got a good handle on the CGT position for the future (my field).

I don't propose to complete IHT 400 but I'll check with a friend who knows these ropes. Seems such a waste of time, (HMRC's and mine) as there is absolutely no loss to Government coffers given the sums involved.

Re previous query, I meant box 9 on page 1 - I assume this is the same figure as at box 6 on page 2?

    Again, many thanks.

Yes. Box 9 page 1 is same as box 2 page 2.

I phoned them first, and they suggested that as I was travelling up (from the Midlands) for a week (to sort mums house out), if I bring my application in at the start of the week, then if there was anything requiring changed, I would be able to correct and resubmit before I travelled home. Couldn’t fault them in any way.

    Hi,
I'm looking for some help please? I have tried to submit the C1 form witht the help from reading this forum and have had the form returned.
My dad died in Jan 2023 with a survivorship clause in his will for my mum. My mum died in July 2024 and this is who the c1 is being completed for.
The C1 was returned with the following comments
1 The will had not been docquetted - will had been doquetted now,
2 Some of the exectors names and addresses do not match the will exactly. - small amendments made but one of the executors has moves since the writing of the will.
3 The declaration does not mention the 1st named executor, my dad.
If I upload a retracted page 2, would anyone mind casting their eve over it please?

    Para 2 needs  some change.

Was dad the sole named executor and the four children ‘whom failing’ substitute co executors?

Are all the children prepared to act as co executors?

What are the name differences and who is affected?

Other than the address move, are there address errors in the will?

What do you mean by dad having a survivorship clause in his will? In your previous thread you were indefinite regarding the house ownership status. This is important and influences what needs to be shown in the inventory?

  • Hi, Newbie here.
Just trying to make sense of the C1 form, for Confirmation of my husbands estate.
In his will he left everything to me and we had a survivorship clause in property deeds.  The estate is below IT level
Can anyone tell me if Legitim is claimed by our kids the amount would be put in box 25 Net qualifying value of estate
