  • My first post on MSE, but can someone advise?

If the rise is 2.7% but the RPI increase is 2.5% as detailed here...

    www-ons-gov-uk/ons/rel/cpi/consumer-price-indices/march-2014/stb---consumer-price-indices---march-2014.html

...is that not enough to get out of the contract without all this?

Sorry if it's a dumb question or I've misread.

The figure that counts is calculated using the most recently published RPI figure before we give you Written Notice so the fact that it dropped after they gave notice is neither here nor there.

The RPI that EE are using is the rate for Feb that was published on 25th March.

    Not the March %

So it seems that EE have lost the plot!! I received an email from the exec office today stating the they are sorry that I am unhappy with the changes and I can pursue my claim through CISAS!!! Hello I have already won my case!!! The email has a different case reference number and account number. What a joke!!!

I'm not sure if I have missed this already but if you took out the contract before October 2012 and have since upgraded, would you have a claim to back date to the time of upgrade?

Well I finally received my update from CISAS late yesterday.! What is
interesting is my date of return.

Case No: XXXXXXX - XXXXX v T-Mobile (UK) Limited

We acknowledge receipt of the company’s response to claim, a copy of which
is attached for the customer’s attention.!! The customer is invited to
submit comments on the response, within 5 working days from the date of
this letter (letter dated 14th April), that is, on or before 21/04/2014

So both Good Friday and Easter Monday (public Bank Holidays) have been
classes as working days???!! Is it worth me contacting them to point this
    out?

Regardless, having read through these forums over the last few weeks I note
that RC suggests posts #688 and #689 with a few other comments made on a
variety of posts.! So I will use these.! Have used the templates so far and
    will continue to do so.

Haven't posted their defence document contents - but if anyone thinks it
would be worthwhile I will do so.

I am on a pre October 2012 contract with T Mobile, and the defence
submitted by EE is precisely the same as that of Persil33 at post #755.
Would be good to get an update from them as to how they proceeded

Just to update, contacted cisas yesterday and they confirmed that the date of my response was incorrect and should have been the 23rd .

also checked my supporting evidence had been received by ee (having submitted application online i was bit worried about them noypt recieving it-but they did) as there defence seemed to show complete disregard to my evidence, indeed some of the defence suggested I had provided no evidence!!??

Now have my response ready and will be sending it to them today, so hear goes nothing

Its interesting to see that from the previous T Mobile thread, the head adjudicator has form for erring on the side of the provider https://forums.moneysavingexpert.com/discussion/4536143
