I've received EE's defence and they seem to be building up a case for material detriment.....this is para 32.5
32.5 In particular and by way of illustration, a historic comparison of RPI to CPI shows that the difference between the two is not typically material the following table sets out, for each of the last 24 months:-
(A) the percentage change in CPI over the previous 12 month period;
(B) the percentage change in RPI over the previous 12 month period;
(C) the difference, in percentage points, between the percentage change in CPI and RPI over the previous 12 month period; and
(D) the average of the difference in the percentage changes in CPI and RPI, calculated over the 24 months period

I also note they have my monthly billing amount wrong, they've quoted £36 when in fact its £44!
Got to hand it to EE they must really LOVE their customers, I think teh legal department is tryingto play the role of Retentions!!
Anyway way a response below which should have them scratching their heads again!
Paragraph 32.5
The average 0.5 points difference over 2 years equates to an approximate increase 20% higher than the previous contract would have allowed, and this will be compounded over a 24 month contract. In addition the current price rise that EE have announced whilst, I have been seeking a penalty free cancellation, amounts to an increase 58.8% higher than CPI would have allowed. But what these figures clearly demonstrate is that EE are fully aware of the impact that the difference between CPI and RPI makes, and one can only conclude that EE must consider the difference to be material to its profit line. Why else would they have changed from a term that restricted them to the lower official measure of UK inflation (as used by the Bank of England to regulate the economy and interest rates), to the higher statistic which is no longer designated as a UK National statstic as it does not properly reflect the true inflation rate.?

Does anyone know the threshold for EE being over RPI?
RPI is 2.7% which is what they say the increase is.
the actual increase in real terms is 2.71% therefore over RPI.
it's only 0.01% over but they chose to round up to nearest pence rather than down? would this make a difference?
£5 -> increase 2.7% -> 13.5p EE approx increase 14p
£15 -> increase 2.7% -> 40.5p EE approx increase 41p
£25 -> increase 2.7% -> 67.5p EE approx increase 68p
£35 -> increase 2.7% -> 94.5p EE approx increase 95p
it's only 0.5p out but over is over right?

Received an email from CISAS today after accepting the decision. Does this sound a bit weak to anyone else??
We acknowledge receipt of notification from the customer that they accept the Adjudicator’s Decision. Where written confirmation was provided a copy of the correspondence is enclosed with the company’s copy of this letter.
The parties must now act in accordance with the adjudicator’s decision within a maximum of four weeks of the date of receipt of this letter, which is on or before 12/05/2014.
THE COMPANY MUST NOTIFY US THAT THEY HAVE COMPLIED WITH THE ADJUDICATOR’S DECISION.
We would like to hear from you if the Company has not complied with the Decision by the date above. As the adjudicator’s decision has been accepted, it is binding on the company. However, please note that CISAS does not have an enforcement or regulatory function. The independent regulator for the UK communication industry is Ofcom.
That is the standard letter - don't rush EE to comply (unless you need the cash) just enjoy your free use of the phone.

Thanks RC, I replied with a similar argument, now I just have to wait. Would them mis-quoting my monthly price affect their argument? they clearly haven't even read my contract before copying and pasting the defence.0 -
