Hi Guys,
Some advice regarding a PCN issued by Euro Car Parks would be very much appreciated. The vehicle entered a carpark and stayed for under 15 minutes and left without using the pay-by-phone service. The times were captured on entry and exit by ANPR to 'calculate the length of stay'. A notice has been sent to the keeper of the vehicle and an appeal has not yet been lodged.
What would be the best approach to take in trying to get this overturned? I have seen a lot of conflicting information and other posts that are more relevant when lodging a POPLA appeal.
Cheers for any help0 -

UNLESS YOU HAVE A SUCCESS STORY RESULTING FROM A LANDOWNER/RETAILER (OR SIMILAR) COMPLAINT, THIS THREAD ISN'T FOR ANY OTHER PURPOSE. PLEASE DO NOT POST ON IT - UNLESS ONE OF THE ABOVE APPLY.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I don't usually comment on forums but this forum helped me so much I thought it only right to share my success and say a big thank you! I received a PCN on Monday for overstaying 15 minutes in Luton Retail car park on Gypsy Lane back in February. I didn't know there was a time limit so was very surprised to receive the PCN. At first I was just going to pay it because I didn't want the hassle of trying to contest it (I've always been of the impression that appealing is a long laborious process) but after googling it and coming across this forum I thought hey why not give it a go there's nothing to lose in challenging it and given that these private parking companies prey on innocent people I didn't want to give them my money. Also due to the fact that they had taken 39 days to actually issue the PCN I felt that I at least had a fighting chance.
I read the Newbies thread and firstly complained to the retailer that I visited which in this case was Costa and then I used the template complaint to also complain to the car park company (G24 Ltd) via their appeals form on their website. I submitted both complaints on Tuesday and by this morning (Thursday) I had already received an email from G24 to say that they had waived the PCN!!
This forum saved me £90 so to anyone reading this and thinking should I bother appealing please do! And thank you once again to this forum.

Good stuff, well done. Now the real message from your brush with scam is to steer clear of it in future. Almost any private car park these days is a bear trap, so check if there's a sign on entry, look up at any lamppost or pole at the entry point for ANPR cameras, read signs in the car park and comply with the rules. While I don't like some private entity dictating what I should/shouldn't do, I take the attitude that every time I work within their conditions, I am denying them their lifeblood. Please note, we are not a legal advice forum. If Costa have a website or Tripadvisor/Facebook page you might warn the latte drinkers of the presence of these scammers in the car park. You never know how far you can go until you go too far.0

Success, thread here: https://forums.moneysavingexpert.com/discussion/comment/76954516#Comment_76954516tl;dr: Received a PCN from Horizon Parking for a 1.5 hour overstay in a Tesco Extra car park (legit long shop in a huge store, first-time there, unlit signs at night so unaware "restrictions" etc.). Took letter & bank statement to Tesco CS desk and they cancelled it no problem. Told me "they get a lot of these", and "not to worry". Weren't even that bothered about looking at my statement.Took a while for Horizon to cancel it, (they let the appeal timer run right down to 0), but it's now cancelled. Shows appealing to the Landowner works as first priority. Unlike me, I'd advise getting some proper proof before the appeal runs out though!
