    If as you say the delay to your flight was because the plane you were travelling on was late from Madrid that is a knock on effect and you are due compensation

    the challenge is that there is nothing in the regulations that state an airline must rebook on another airline so their preference would be to offer you the next available flight with them (there were no more Air Europa flights that day) you should have received duty of care; hotel, meals etc during the wait
    Airlines can resell your seats/allocate to standby etc if you are not at the gate at a certain time so they have not done anything wrong there

    Just wanted to say thanks for this. I shall have to keep an eye out for the ruling. We are in the same position with Emirates, connecting flights, Emirates talking about delays not applicable outside of EU, blah, blah. Anyway I am now going to put off taking action through the courts for a little longer, in order to await the appeal result. Hopefully the result is in passengers favour and merely writing to Emirates, referring to the ruling, will be enough for them to settle. Fingers crossed.
  • Had a flight delay back in January 2015, Manchester to Innsbruck. The flight delay itself was just under 3 hours.
    However, during this delay Innsbruck airport closed so we were diverted to Munich.
    We finally arrived at our holiday destination 6 hours late.

    Is it possible to apply for compensation for this delay?
    Would it be the airline who would be liable or the holiday company we booked through (they were responsible for the transport from the airport)?

    I redeemed loyalty points with a non-EU carrier (and paid the relevant taxes in cash) for a flights that operated in to and out of EU airports. The inbound flight from Madrid was delayed 4 hours 21 minutes and arrived at its non-EU destination 4 hours 21 minutes late. I am an EU citizen but 'bought' the ticket outside the EU where I currently live. Do I have to be resident in an EU state to submit a claim for compensation ? Any thoughts welcome - ever hopeful.

    Thanks. I did that but there was no real clarity from it for this particular situation.

    We did end up at Innsbruck airport by a coach ride from Munich airport but 6 hours later than planned.

    We then had a trip in a mini bus to the resort.

    In the guide, there is a ruling about arriving late at a destination after a small initial flight delay (the Folkerts judgement), but that is for missing a 2nd connecting flight.

    I hope someone could advise further on this.
  • I used the guide and referenced the cases you noted. It took a couple emails but finally said they were interpreting the ruling incorrectly and I would take it to the next step should they not compensate me. They did!:T

    what was the reason for the delayed departure?
    why did the airport close?
    try your flight details in a couple of NWNF sites (EUClaim, bottonline both have free checkers) that should give an indication whether compensation is due or not
