Just tried EU Claim and they state possible 600 Euros, Bott & Co just states N/A where value should appear.
  • If you wish you can phone Bott & Co to enquire as well. I'm not sure why their website would not play ball in the case of a clear 'knock on' delay. It is now pretty clearly established that airlines need to deploy resources sufficient to cope if earlier flights are delayed. If you have not already done so read Vauban's guide and then use nwnf lawyer or diy route.
  • I am trying to confirm whether a flight I took with Thomson back in Feb 2010 was over 3 hours delayed - it was border line. Does anyone know a site where I can check the flight arrival time?

Makes no difference. You are out of time, unless you have already brought legal action. 6 years limit on bringing to court. Airline will safely ignore you.
If you're new. read The FAQ and Vauban's Guide

  • Thanks JPears for response. Is there anywhere I can check the details of flight arrivals times?

Flightstas may have it. You need to register (free) to get historic.

So back in November last year I posted on this thread as follows:
    http://forums.moneysavingexpert.com/showpost.php?p=69444171&postcount=9015
The advice then was that compensation was unlikely because of the circumstances, but I pushed ahead with a claim through Resolver and this morning - over 4 months after lodging the claim - I finally have the money in my bank account. I guess the moral is "Don't give up !" despite the various hurdles en route. The process does work, even with reluctant airlines. Thanks to all who contribute to this thread, reading through it (and especially Vauban's Guide) helped me understand my rights and provide the confidence to persevere. Rejecting the offered vouchers was especially thought-provoking !

The full chronology is as follows:
26 Oct 2015: Flight from Gatwick to Lisbon delayed by nearly 4 hours. 2 passengers affected.
1 Nov 15: Compensation claim submitted via Resolver
15 Nov 15: No acknowledgement or response from TAP after 2 weeks; case escalated through Resolver
4 Dec 15: Response from TAP admitting that delay was due to “operational reasons”, confirming my entitlement to 400 euro per person, and enclosing electronic vouchers to that value valid for future flights with TAP. I rejected the vouchers immediately and requested cash.
8 Jan 16: Resolver attempted to close my case because there had been no recent activity and they assumed it was resolved. I requested it remain open, which they agreed.
28 Jan 16: Still no response from TAP, case escalated through Resolver
12 Feb 16: TAP asked for bank details in order to arrange bank transfer. Bank details provided immediately.
29 Feb 16: No response from TAP, case escalated through Resolver
10 Mar 16: Still no message from TAP, but cash from them deposited in my bank account.
  • Hello,

I have been on a delayed flight, delay over 5.5 hours in Europe by a charter. The airline admits to delays due to technical issues being their fault but only for under 3 hour mark, the rest of delay being attributed to adverse weather conditions (December 2015) and waiting for flight control to allocate air slots.

As the delay being their fault is under 3 hours they mentioned they are not obliged to pay any compensation, however as a goodwill gesture they agree to pay €100 per each passenger (rather than €250 pp resulting from my claim).

To what extend can I assess what they tell me is true? Is there any regulator/ombudsman service that can check the delayed time and the real cause?

Effectively, should I accept the airline's offer? Or should I ask them to reconsider, risking loosing even the €100pp. Since they offered some compensation I get a feeling this may by just a trick not to pay the full compensation to the passengers. If you could advise what to do..

    Many thanks,
    Monika

Monika - airline details etc required (so please post on thread appropriate to your airline) although you may wish to read Vauban's Guide prior to posting again.

Without further details impossible to advise whether you have valid claim or not.

Your thoughts are on the right track. But read Vauban's most excellent guide and provide more details about the flight and circumstances. Did the weather actually affect your flight directly?
