    Most 'regulars' will be aware of the info in this link but the final paragraph mentions possible revisions to 261/2004.

    Proposals to change EU261 were first proposed by the EU Commission in 2013 but the EU Parliament refused to discuss them and the changes stalled. Some of the changes include increasing the length of delay that triggers claims from 3 to 5 hours on short haul and 9 or 12 hours on long haul. Liability for the care of customers caught in long delays such as volcanic ash would be limited to 3 days accommodation at 100 Euros a night, the only obvious improvement would be an absolute obligation to rebook passengers on alternative airlines if delays exceed 12 hours.

    If we vote to leave the EU on 23rd June, it will be up to the UK government to decide whether we agree to continue enforcement as countries such as Norway and Iceland do even though they are outside the EU or abandon it altogether, which I have no doubt the airlines will push for. Think carefully before making your mind up!

    But as this has gone through the Supreme Court in the UK does it not already make it binding regardless of what happens?

    The Regulation 261 is purely an EU law, unlike the Package Travel Directive which was translated into UK law by 1992 UK Regulations. Any purely EU regulations may fall by the wayside if we leave the EU. It would also mean the re introduction of duty free goods but limit everyone to 200 cigs and 1 litre of spirits, if either of those issues matter to you.

    I need some advice please.

    I've used Resolver to put a claim in to SAA for a delayed flight in Oct 2012. Flight was delay because the Pilot took ill during boarding. Arrived in Cape Town more than 24hrs late after missed connecting flights etc.

    SAA have written back to say because the pilot was ill and they had to wait to get another pilot until the next day we are not entitled to compensation.
    Is this correct or am I being fobbed off?

    Probably the latter so search the flight delay thread for "illness". Read Vauban's excellent guide or contact a no win no fee firm (assuming that you want compensation!).

    Thank you David_e for your response. I did previously take Justice13075 advice and read Vauban's guide but nothing about crew illness is mentioned in the guide.

    I've just searched the thread for 'illness' and found what I needed.
