  • Flight details: TCX0245 Holguin to Manchester
    Scheduled departure Holguin 2105 GMT 29 Sept 14 (1705 local)
    Actual Departure Holguin 2005 GMT 30 Sept 14 (1605 local)


    Scheduled arrival Manchester @ 0605 GMT (0705 local) 30 Sept 14
    Actual arrival Manchester 0426 GMT (0526 local) 01 October 14


    (Holguin is minus 4 hours from GMT / local time in UK is plus 1 hour)


    The first letter from Thomas Cook issued in Holguin stats this:
    "As you may be aware, the aircraft initially had a technical problem resulting in a small delay that had been resolved by a local engineer, however during this time the runway in Holguin had been hit with a lightening strike causing surface damage"


    The second letter which was handed to us at Manchester (almost a day late by then) makes no mention of the technical problem but states "This is to confirm that the TCX0245 Holguin to Manchester was delayed due to a lightening strike from a thunderstorm, causing surface damage to the runway, resulting in the closure of Holguin airport"


    In my mind they've changed the story to best suit themselves, we waited several hours before the storm. Once we were all on board and seated the Pilot announced sorry for the delay due to a technical problem, we will be looking to take off as soon as possible once we get clearance. Then he came back on later and said it was unlikely that we would fly but given the circumstances of how long we'd already been kept waiting they would prepare a meal. Then he came back on during the meal and said we wouldn't be flying.

    Assuming lightening actually did hit the runway, AND cause damage, you need to establish if other aircraft were delayed. Flightstats could be helpful.
    You also need to establish the length of the delay caued by the technical. If it was the majority of the delay up to the 3 or 4 hours ( I don't know the distance of your flight) then you will probably find a judge would find in favour of your case.
    Actually the details on flightstats are a bit confuding, but clearly shows several adjustments to your departure time.
    My guess is your crew were out of time for such a long flight....

  • Hi I have submitted a compensation claim for a flight delay after recently learning I was able to do this. Basically we were kept sitting on the plane for over 3 hours past our scheduled departure time due to some problem from the airlines end. I have submitted this claim a few days ago and I'm waiting to hear. I just wanted to know my rights on this as this flight was just over 6 years old by around 10 days. Would this make my claim totally ineligible?

    Expect a rejection or ignored as they know there is nothing you can do even if the claim was valid

    Has anyone had a successful claim from an airline where a medical emergency occurred on a flight which then had a knock on effect on their flight. I was delayed flying out to Cancun, the incoming flight from Sanford was delayed as a result of a medical emergency on an earlier flight (not sure on which previous flight the emergency occurred). I just wondered for how many flights they can claim exceptional circumstances for the knock on delay - thank you.

    Hi,

    If your flight was not directly affected by the medical emergency you should be able to apply for compensation.

    Try putting your flight details into a couple of flight delay calculators and see if they think you have a good case.

    Thank you, it was Thomson Airways 30th Sep 2011 Newcastle to Cancun. I will try some of the flight delay calculators.
