    It's a reasonable offer - you asked if it's worth the extra hassle - I'm afraid that's a decision only you can make.

    Are you're willing to take them on yourself & go for the full €500, or do you want the moral satisfaction of having the airline admit that they are liable?

    It's possible that they might offer abaalan if he (she??) goes back and says "Look, I know we are entitled to the full amount but to avoid everyone spending time and effort and cost of going through the whole court process, we'll split the difference and accept €200 per person". Given it is almost certain they know their full liability, it's a result for them and abaalan would be better off than if he used a NWNF firm.

    For the €50 he'd be missing out on, it probably wouldn't be worth the DIY route unless there were quite a few travelling in the party. It's not a difficult process to go DIY but it does involve some commitment of time etc.

    Your contract with the airline is to deliver you to the airport. Any onward journey does not form part of the contract and this is a consequential loss that the airlines are not responsible for. Unless they give you a gesture of goodwill, you could speak to your travel insurance and see if they will cover.
  • Hi, 15 months ago my partner and I were due to catch a flight from Holguin, Cuba to Manchester. We waited at the departure area and some people boarded the plane but most including us waited for several hours before we were allowed to board. Once on board the pilot announced sorry for the delay which was due to a technical problem (we have a letter stating this) we were then informed we might not be able to fly due to runway damage. It took eight hours from the due departure time to get us back through departures (being handed our exit visas in alphabetical order to re enter the country etc,) then back to our hotel at midnight having left at 8:30am. We'd accomplished a meal on the plane in 15 hours... the following morning we had to leave at 8:30am for our flight which eventually left / arrived 23 hours late into Manchester.
    We maintain the flight was delayed due to a technical problem and because of this we encountered adverse weather. The airline Thomas Cook gave us a letter when we arrived at Manchester stating the delay was due to adverse weather and therefore no claims under European Law were applicable. This contradicts their earlier letter, we have copies of both.
    Who is right?
    We've stuck a claim in with your advice using Resolver which they are "looking into" for six weeks now.

  • Hi,

    We were delayed on a flight by over 3 hours returning from Bulgaria in January. The delay was due to passengers being transferred from another UK bound flight to our plane.

    When we got back we wrote to the airline, Jet2, as per the guides on this site. Jet2 have refused the claim stating that our flight was a charter flight as it was part of a packaged holiday and that the delay was cause due to the cancelation of the other flight which was also charted by the same tour operator.

    I have since been on to the CAA delayed website but that has stated that we need to get in touch with the Bulgarian CAA.

    Can anyone offer advise on if I should pursue this with Jet2, the package holiday operator and if I do need to get in touch with the Bulgarian CAA.

    Your claim is with Jet2. Based on your description of events, the decision to delay your flight was an operational one taken by Jet2, and fully in their control. You are therefore due compensation. If Jet2 don't budge, you will need to take them to court - either yourself or via a NWNF lawyer (easily done - for a slice of your award). Read my guide for what to do next.
  • I had a seriously delayed flight with First Choice to Cuba in 2012, i have the dates of travel but no flight number. Any ideas on where i can find confirmation of this delay ?

    Assuming the airline was actually Jet2 and not a Jet2 holiday where they had chartered another airline as a stop gap if their own planes were unavailable. Even so Jet2 probably still liable.
    They will try to avoid payment at almost all cost, excuses and misleading statements so you must persevere or hand over to a NWNF company, such as Botts.

    I can't post links on here, but try searching for a uk based website called flightstats. If you sign-up as a member (free), you can search for historical flights by departure airport, route & date.

    April 2016 - successfully claimed €1600 from Thomas Cook for 6 hour delay in August 2015
    Old debt passed to collection agency? Issue CCA request & possibly have debt rendered unenforceable. Feb 2021 - £42 of old debt legally written off & cost £1 per account.
