Hi, So I gathered all the information I needed to complete a compensation claim (using a MSE template). I posted it and I have had it confirmed by the contact centre today that the case was created on 16th April (the day after I posted it, so I agree with them on that point). In my letter, I gave them 14 days to reply, they had not, hence my call today to confirm that they had received it. They told me that although the case was created on 16th, it was only opened on 26th (amazing coincidence given that I called them today) and that they have upto 56 days to reply, but in the next sentence, they say there is no timescale for them to settle and they can take up to 2 years to close the case! Given I spent over 16 mins holding and then talking to someone today, can I get reimbursement of my mobile costs but more importantly, am I within my rights to now pursue this legally as my letter offered them 14 days to reply which they obviously ignored! Oh by the way, I also submitted an online complaint today (to make sure they have an my claim and that says they will reply within 28 days)...

hmmmm, This appears to be the latest, most common asked question after the recent Voucher nonsense that Flybe caused.
The advice appears to be absolutely clear from us all, the airlines have had since 2004 to absorb the implications of the regs, now the poor airlines are swamped with claims, since many have been on hold pending Huzar and Dawson (which was of their own choosing) , now they expect Claimants to just sit and wait, I certainly wouldn't wait after they ignore a NBA.
To me you would look foolish to issue an NBA, then just to sit back, and wait indefinitely ?

As it was your original flight that had moved and you arrived less than 3 hours late then no compensation is due

Also we landed at north terminal instead of south terminal which obviously increase the delay by more than one minute. Do you think I am allowed to get a compensation ?
By the way easyjet said the would give refreshments but nothing was done and everything (even water) was expensive as usual on board.0 -

you can apply but I would expect they will want you to take them to court to show your evidence that the delay was over 3 hours
If you put your flight number through one of the NWNF sites it does say there is no compensation due so you would need to be prepared to follow the court process yourself. Info in Vauban's guide0 -
Further to what Caz has said...
FR24 shows stop time (engines off) at 00.43.
If departure was due at 21.50, that would leave 7 minutes for them to get a door open and stop the clock. From my experience it would be unlikely to take that long. Unless you have proof that it was a delay of 3 or more hours you do not have a claim.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

Yes
1) Post on page applicable to your airline
2) Read Vauban's guide first (Google if you cannot find one of the many links)
3) Register for flightstats
4) Then - if no luck - post again with all flight/airline details (on airline page) and hopefully someone will assist.0
