Although they have the excuse wrong you still would not be able to claim as the regs only apply to EU registered airlines or an EU airline leaving an third party country into the EU.
this is incorrect
The regulations apply to all airlines leaving an EU country
or where the flight is departing from outside the EU to an EU country it needs to be an EU airline
As Edinburgh is in the EU it does not matter that it is a non-EU airline0 -
Batman44/Caz3121 Yes As far as I'm aware the regs apply to all airlines flying in and out of an EU state.
So just to clarify, are US Airways wrong in what they are claiming , and if so can you give me some evidence as to why this is the case.
Thanks in anticipation.

No. It applies to all aircraft LEAVING an EU airport and to European airlines only flying INTO a European airport.
If you want to understand why the airline is wrong, and why you have a case, either read my guide or approach a NWNF lawyer.0 -

Yes, just read the regulations, or Vaubans guide.
It is now excepted beyond any doubt that technical problems with an aircraft cannot be classed by the airline as an EC
EDIT ~ ohh Vauban beat me again, ho hum time for lunchAfter reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I had a flight a few years ago that was delayed by 7 hours. After 5 hours we lost patience and decided to get another flight. Am i still able to claim compensation?
Thanks

I don't want to start a new one if one already exists.0

a little over 5 years ago, if i remember rightly it was a technical fault but i vant be sure. We did receive a refund on that portion of our ticket.
Have a read of Vauban's guide in the sticky
I assume you know the flight number and date
It is unlikely that after this length of time a NWNF will take this on so you would be dealing with this yourself, there are template letters to start with after which you should get a response from the airline possibly confirming the reason for the delay the you decide what to do next0
