  • The stop isn't the issue, I get that it was unavoidable. The treatment of passengers was appalling. Both airports were operational at the time.

    My view is that weather reports may have been available prior to departure at BHX and they knew there would be problems and the flight should have been delayed at BHX.

    If the airline refuses to compensate, you'd have a tricky legal claim. Your case would use the arguments of the Wallentin "third question" judgement as well as the Eglitis/Air Baltic judgement. Hardly straightforward though.

    Yes. It's the airlines' latest excuse to try and circumvent the Supreme Court's decision. It is rubbish, of course. But you will most likely need to take them to court to get your money. My guide has the details.

    So who is going to send a vitriolic letter to CAA complaining about Thomson's latest vexatious, infact blatantly dishonest, tactic in claiming "hidden manufacturing fault" in every case?
    Not that it will do any good......
    Thomson - stop being a bunch of sad w*****s and treat your cutomers with the respect they deserve.

    Of course, if the aircraft had a "hidden manufacturing defect" Thomson can claim an indemnity from the manufacturers not only in relation to passenger claims but also for their own losses.
    Don't waste time with correspondence. Just issue your claim and insist that Thomson disclose all their correspondence, emails etc that have passed between them and the manufacturers. Do you think that Thomson will want all that made public? Answers on a postcard marked "Go for it"
