I wrote to American Airlines on 8th November claiming flight compenstaion for an aircraft that went tech in the air after taking of at heathrow aiport. I arrived 24 hours late at my destination in the USA. I used the Vauban template letter to American Airlines. I had no reply so rang Bott and co who were not interested as the airline was non EU !!! but it did take off from Heathrow , still, no ,not interested. After all this time I have received a very nice email from American Airlines wishing to transfer £498.87 to my account. Nice start to the New Year.

Glad to hear it joanfred - well done to AA for obeying the law. Other British airlines pls take note! (We know you read these posts ;))
  • Jet2 initially refused to compensate us for our 4 hour delay from Crete in 2012 claiming "extraordinary circumstances". They have now again refused to compensate even under the new Supreme Court ruling now quoting the Greece CAA as enforcing their decision. However, I know for a fact that the fault with the aircraft occurred while it was being used on a much earlier flight that day, and because of that our incoming aircraft was delayed leaving the UK by 4 hours. When the aircraft landed it was quickly refueled and cleaned, we boarded and it took off ...
    Any advice please ?

I recently flew back from the US to London and my delay was over 12 hours. I booked the holiday through lastminute.com and the airline was United flying to the states and then "Lufthansa operated by United" for the return (which was delayed). Does anyone know if this counts as flying with an EU airline so I can claim for compensation?

    Thanks

Was the aircraft LH from the U.S. to the UK? If so then as LH is an EU community operating air carrier you can claim.
Posts are not advice and must not be relied upon.

I think the plane itself was a United one, but the flight was booked with LH. My flight number started LH (although I suspect there were also passangers who'd booked onto the same flight through United). So it seems I can claim but I don't know how it works with airlines selling tickets for other airlines.

To be clear, if the delay was on a United plane flying into Europe then you can not claim. The fact that you booked the flight with LH, or that is was a codeshare flight, is immaterial unfortunately.

Ah, pity. Thank you for clearing that up Vauban. Perhaps United will make some sort of gesture anyway.
