  • My flight to Dominican Republic in Jan 2011 was delayed by 24 hours. I have spent over a year trying to get compensation from Thomson Airways but today received a cheque for £950 (2 people). My claim was originally rejected because I claimed after their 2-year limit but the decision by the Supreme Court has changed that. Great news !!

    Would appreciate any advice as to what we can do next......

    We took Icelandair to the Small Claims court but the case was put on hold pending the Jet2 v Huzar challenge. We heard nothing further. It was only in December that we discovered that Jet2 had lost this appeal back in October. The courts had not been in touch with us. We then phoned the court only to be told that we had to put it in writing for the case to be taken off hold. We sent a letter in December and have heard nothing since. Anyone any ideas how we progress this?

    Phone the court and ask them for an update.
  • We were delayed due to a passenger attempting to flush a nappy on the preceding flight and in doing so blocked the toilet system. Our Gatwick flight eventually left from Manchester 11 hours and 45 minutes late.
    Our claim has been rejected by Thomson due to them disputing between exceptional and unexceptional circumstances.
    Their legal department will not engage with us and merely repeat that the delay was caused by a blocked toilet. We have now largely given up but would be interested to hear from anyone on this matter.

    This doesn't sound extraordinary to me - this sounds like an operational failure to clear a toilet or provide an alternative 'plane. But the airline hope that by stonewalling you, you will give up on your claim. Which it sounds like you have almost done. Have a read of my guide if you get a change of heart.
  • Delayed 10 hours in September 2013, complained to airline and got refused compensation, they said it was a technical fault. Took complaint to CAA, same outcome. Took up complaint again after new Jet2 court ruling, bingo £640 compo received December 2014, all thanks to MSE. Keep complaining if at first you don't succeed.
  • I had contacted easyjet about looking compo for a cancelled flight in July last year. I received a reply today that we couldn't get compo as it was "extraordinary" circumstances. They said - "Having looked in to the flight report which had been compiled for the type of disruption, I can see that your flight had been cancelled due to High Winds & Storms."
    Its funny because that weekend was a scorcher and we were running around in shorts and teeshirts!! There was definately no high winds or storms!
    Am I being palmed off here or what??

    Have you read Vauban's guide?
    What does flightstats show for both the departure and arrival airports around that time? was your flight the only one with any delay?

  • My wife & I Holidayed in Tunisia in May 2008, we were delayed by 12 hours on our return journey, I read the Flight delays article November 2014 & decided to make a claim.I completed the Thomas Cook online Claim form on the 10 November 2014 & a few days later received notification Thomas Cook would investigate the claim. Today I have received an email from Thomas Cook stating that the flight was over 6 years ago so I cannot make a claim, according to the article it says you can make a claim back to 2005. What should I do next?
    Are Thomas Cook correct in refusing a claim for compensation because the flight was in May 2008?

    Yes. Though you can claim back to 2005, you can't go to court outside of six years. So you can - and will - be safely ignored by the airline.
