  • My wife was delayed using Flybe for over 3 hours, Southend to Rennes. This was all booked using Flybes website. We have entered a claim with Flybe several weeks ago. We have now had a reply stating that the route is run by Stobart Air and they have sent the claim to them. My question is who is responsible? Because I think it should be Flybe and they are now buck passing.

    You claim against the operating air carrier - which in this instance is Stobart (they seem to have a kind of codeshare agreement with Flybe). They are based in Dublin, so you may need to use the ESCP to start legal action if they don't respond to your letters.

    Hello I was held up on the tarmac for 3 hours in Abu Dhabi because of the fog a couple of days ago with a KLM flightshare (booked Etihad). There was a screaming child for the whole duration and nothing was done about it (and I mean screaming). I then missed our connecting flight from Amsterdam to Cardiff due to the delay and had to catch a flight 11 hours later. I was given food vouchers amounting to 10Euros to get some food. I've a few questions if anyone can help please... 1) I'm not entitled to compensation for the original delay as it's due to fog? Just wanted to double check. 2) I'm not happy with the way we were just sat on the tarmac and it was made 10 times worse with the screaming child. Is there anything in the way of compensation for that or can I make a complaint and something will happen about it? 3) 10 Euros for a 12 hour stint is ridiculous. I had no money to get anything else. Is there a minimum amount for 12 hours or is it a case of you get one small lot for 3 hours? Again, would something happen if I made a complaint? Thanks, Andrew
    Ah and the plane was absolutely boiling sat on the tarmac with no air con on at all.

    Actually, I just had a thought. The initial plane was late coming in and so we were delayed a little bit boarding the plane. If we had taken off on time then there would be no fog to delay. Would that affect things?

    No compensation for weather delays. A short non weather delay initially is unlikely to change that.

    By all means write to complain about your treatment. You might get some airmiles. In terms of your right to care, the Regulation isn't that prescriptive but says passengers should get "meals and refreshments in a reasonable relation to the waiting time". If you had to spend more, send in copies of your receipts.

    As this was a non-EU airline (I assume it was the EY77 on the 2nd Jan) departing from a non-EU airport then EU compensation does not apply whether the airline was responsible for the delay or not
    The duty of care should be based on the meals etc required during the delay. If you had spend additional you could have tried reclaiming. Did you ask for further vouchers?
    Not sure what could be done about a screaming child...one of the issues with air travel is you get to sit in a large tube with a mixture of people you may not normally choose to sit with
    You could try your travel insurance and see what it covers for that length of delay
  • Ok thanks guys. Can't remember the flight number off the top of my head but it was KLM flying to Amsterdam. Don't think it'll be worth the time then as I had no money to spend for receipts etc. The lady at the desk said that's all she could give us.
    I personally think it they should put the families etc together in flights. One of those things looking back but was really bad at the time.

    If it was operated by KLM then could it have been the KL438 due to depart 01:45am Saturday morning?
    Although a EU airline, Flightstats shows all 15 of the departures from 12:50am to 02:05am had significant delays which will likely back up the weather defence (02:30am was the first departure after the previous flight going out unaffected with got off at 12:24am)

    Apart from strangling the child if it happens again I can't add much more to what has been suggested already.

    I suffered a severe flight delay in January 2012 following a trip to South Africa. The flights were booked through Major Travel (Travel Agent) and we are told that the tickets were written to Swiss Air. On the return leg we were due to fly into Frankfurt via Lufthansa and finally home with BMI. It appears that around August 2011 Lufthansa cancelled the BMI flight (having acquired them) but we were never allocated alternative seats. We are told by Major Travel that they had contacted Lufthansa and had been assured that we were reallocated. However on arrival in frankfurt at 08.20 there were no flights available for us until 16.40.

    Swiss Air say nothing to do with us and BMI no longer exists.

    Are Lufthansa liable and does anyone have contact details to raise the necessary claim
