  • Jeannie, the CAA are not your friends. They are not an ombudsman. They represent the airline industry so forget them.

    Claim 1 is out of time. Forget it

    Claim 2.
    Write to both airlines inviting one or other of them to accept responsibility and saying that if they refuse you will sue both. Then do it.

    Claim 3
    Your claim will be statute barred on 12th January 2015 so you have two choices.
    (a) Forget about it and move on.
    (b) Sue them but you MUST do this by 12th January at the very latest. If you miss the deadline it will be too late. And by "sue" I mean actually commence Court proceedings, not threats, letters, whinges or anything else.

    My parents have recently returned from Las Vegas to Gatwick but got delayed as their plane would have been the Virgin plane that had to make a nonstandard landing and was flying out to pick them up, as that plane didnt make it to Las Vegas they got delayed 23hrs.

    Hi,

    We recently flew LHR-MAD-SCL-ZCO.

    On arriving in Madrid we were told that our MAD-SCL flight had been cancelled. We were rebooked but told to fly to Buenos Aires and then get a connecting flight to Santiago.

    Eventually we arrived at our final destination 8 hours late. Our ticket was booked with Iberia but LAN were the operating airline. I assume that I would complain to LAN? Has anyone else had a complaint with LAN by any chance?

    Thanks for that Vauban, I would expect the UK courts to follow the SC decision as in the Vergara case below.

    We'll find out next month, not long to go.

    Isn't that now Courts 4 Jet2 0? (as RyanAir were 'borrowing' the Jet2 argument)

    The Scottish Sheriff Court was recently requested to sist (stay) Ms Vergara's flight delay case by Ryanair to await the outcome in Van der Lans v KLM. The Sheriff rejected the request as the issue has already been settled authoratively by European jurisprudence and been considered by the UK Supreme Court in Jet2.com's appeal submissions.

    Yes. They really don't know when they're beat do they?

    I am reminded of the Einstein definition of insanity - "doing the same thing over and over again and expecting different results" - and wonder at what point they will pause to appreciate just how ludicrous they are being? I can only hope their lawyers are giving them a suitable discount ;)

    I don't think you can argue with the judges reasoning so it should become 5 nil in February. If that happens I hope the courts will stamp some authority on the situation.

    Most courts are rejecting applications for a further stay, especially if made by letter as most have been. Most airlines have given up and are settling claims, e.g. Thomson and Thomas Cook..


    Exceptions are Jet2, Ryanair and Wizzair all of whom have issued a formal application to stay cases. This application will be heard in Liverpool, which is handling most cases, at the end of February.
