    Actually, it depends on the basis on which Titan were engaged. If Ryanair were the operating air carrier initially and then wet leased the Titan plane (and crew) then the claim would still be against Ryanair, IMHO. But I have no doubt Ryanair would squeal like pigs that it wasn't their responsibility!

    (Preamble 7 of the Regulation states: "In order to ensure the effective application of this Regulation, the obligations that it creates should rest with the operating air carrier who performs or intends to perform a flight, whether with owned aircraft, under dry or wet lease, or on any other basis.")

    Small problem - Ryanair don't fly to Chambery. Maybe it was charter flight for holiday company - Clubmed?
    If so claim goes direct to Titam, although as this was a charter flight and not actually available to public unless part of package, does it still count under Reg 261/2004?

    Have a question regarding the recent Swanwick Air traffic computer failure which occured on Friday 12th December PM.

    We were on a flight which was due to leave BHX but the events of above unfolded and the flight was delayed and we sat on the tarmac for nearly 2 hours.

    We eventually arrived at our destination 3 hours late, we had a connecting flight but luckily were ok as the same plane was used so we didn't miss a flight.

    I took our comprehensive travel insurance with Coverforyou.com.

    Do we have any grounds of making a claim?

    I haven't seen this answered, and wondered what the answer was. My gut feeling was that it was pretty extraordinary, and not any airline's fault, so the only claim would be against the travel insurance?

    In which case it would depend upon the terms and conditions of the policy.
  • Hi myself and a friend had an 8 hour delay earlier this year with a certain airline.
    we started the process of compensation by writing to them and they claimed "extraordinary circumstances" and thus would not be able to compensate us, we wrote to them again and using the E U rules for delayed flights and sent a copy to the C.A.A. we never heard from them again. we have contacted the CAA and the ECC who both say we have a claim but can't make them pay up.
    So, I want to claim using the small claims court but my friend thinks that it would be better to use no win no fee as she has been told that small claims cant make the airline pay up either and thus would be a waste of time.
    any ideas or suggestions???

    Firstly Thank you for the forum, I just got £470 back from BA!! :)

    A friend of mine has a question - they had their flight from Toulouse to Gatwick cancelled by Easyjet, and then got a flight 2 days later but had to get a flight to Bristol. Can they claim refund of fare AND compensation? Many thanks and keep up the great work!!:j
  • Hi, I had a flight cancelled and am being given the cold shoulder, can anyone advise on my next steps please?
    On 1st November my TAP Portugal fight was cancelled due to industrial action by TAP workers. Opodo, who handled the booking, contacted me a couple of days before but could not offer any alternatives to get me home within 48 hours either side of the cancelled flight. I agreed to a refund and made my own way home.
    I have still not yet had the refund. My only contact is with Opodo, who I have rung every week since it happened and all they will say is that the refund is approved but they are waiting for TAP. I have tried to contact TAP but they are ignoring me.
    I don't know what my next step is - Opodo are the ones I have a contract with, but it is TAP that refund the money. Mention of EU Regulation 241/2004 has no effect. Do I sue Opodo under the small claims court or TAP? Is there a regulator I can deal with? Any help greatly appreciated.
