  • Hi Experts,

    I'm curious what kind of suggestions you may have regarding compensation for international missed connections within Star Alliance. I obviously prefer FT input over SA, AC, or AI input.

    My parents were booked DEL-YWG (tickets purchased via AC) on Nov 11/2014 via:
    AI 115 DEL LHR (Nov 11)
    AC 849 LHR YYZ (Nov 11)
    AC 269 YYZ YWG (Nov 11 due in at 20:41)

    Unfortunately AI 115 was significantly delayed (2h56min, I think due to mechanical 787 software issues) which ultimately resulted in them missing the remaining 2 flights in the itinerary. AI didn't attempt to reroute, nor did AC consider AC 859 due to it arriving in YYZ too late to connect with the last YWG flight, thereby stranding them.

    AI put my parents up in a hotel in LHR through the night of Nov 11 and they took AC 857 LHR YYZ (Nov 12) and AC 267 (Nov 12 arrived at 17:45).

    I just have a few questions:

    1) Are they entitled to compensation due to arriving the next day unplanned and 21h04min late.
    2) If they are entitled to compensation, who owes them? AI, AC?
    3) Do the EU rules apply considering that's where they were essentially stranded, or would they fall under AI rules since the delay originated in DEL?

    Obviously any input, or reference would be appreciated.

    I don't see that you have any claim here. Whether you look at the journey as a series of flights or one directly connecting journey, it's a non-EU carrier flying from a non-EU airport so it falls outside the Regulation.

    no EU compensation as the original delay was for a flight commencing outside the EU on a non-EU carrier. The delay that would have qualified for compensation would have been the LHR-YYZ flight but your parents did not turn up in time to board it (due to the AI delay)
    2) If they are entitled to compensation, who owes them? AI, AC?
    as above no EU compensation, they could look to their travel insurance policy to see what it may cover
    3) Do the EU rules apply considering that's where they were essentially stranded, or would they fall under AI rules since the delay originated in DEL?
    no EU compensation, travel insurance would be the place to check, although many policies only cover a minimal amount eg £20 per 12 hours

    you have no claim from AI as they are a non EU carrier and the flight was departing from outside the EU
    What I meant was, if the AI flight was on time and there had been a delay on the LHR-YYZ part of the trip then a claim may have been able to be made from AC. However that was not the case. There is no compensation due for missing the LHR-YYZ flight
  • We have put a claim into Aer Lingus for a delay. Anyone know how long it takes for them to get back to you and whether there is a contact number. Have looked on the website, but doesn't seem to be one.

  • Please advise? Myself and 4 members of my family were delayed 12 hours on 18th - 19th August 2011, BHX - ZTH due to pilots illness in the air and were diverted to Gatwick. I claimed for this to Monarch and got the following reply today, saying its extraordinary circumstances

    "Our records show that the aircraft operating your flight was forced to divert to Gatwick Airport after the First Officer became ill during the flight. It was unfortunate that in spite of exploring all conceivable options, there was no availability within our own fleet to transfer your flight to another Monarch aircraft, or indeed utilise an aircraft chartered from a third party operator, therefore causing an unavoidable delay to your flight whilst a new crew were sourced"

    Should be on Monarch thread ..... what I fail to understand though is why Monarch would need another plane from their fleet or from another firm ..... all they needed was another pilot from their Gatwick base .... something doesn't ring true here IMO.

    Thankyou, we were diverted half way to Zante and landed back at Gatwick. Waited 2 hours ish on the tarmac and a new crew took us to Zante after (with no food or drink on board)
