After a bit of advice please. I received the latest response from Air France following a 5 hour delay from CDG to LHR.
I am sorry to learn that you remain dissatisfied following our replies. I have taken the opportunity of reviewing your file and I would like to offer my own regret that you should have had such a disconcerting experience. However, having read my colleague's replies there is very little that I am able to add.
I should explain, that damage to the aircraft, which is caused by outside factors, and does not occur as a result of our internal processes is a circumstance, which is considered to fall outside of our scope of control and as such does not create liability to pay compensation as set our by current legislation.
I must also explain, that the information you have requested is internal company information, which can only be supplied to relevant authorities on their request.
I believe we have handled your complaint accurately in accordance with relevant legislation and our company policies. As such, I must stress, that we are unable to add anything further and now consider this matter closed.
My main complaints are that I was refused an empty seat on an AF flight from CDG to NCL which would have minimised my inconvenience and the refusal by AF to give details of the aircraft damage as none of this was mentioned at the time of the delay.
Any advice on what to do next please.0 -

Myself and my boyfriend were travelling back from America with my parents during the summer and our flight was delayed for just over 6 hours which caused a host of issues when we got back to England. We checked this website when we returned as I had previously seen others had claim success for similar issues. We followed the suggested procedure, we've all just received close to £500 compensation each! Certainly worth a quick bit of form filling! :T0

Sorry I haven't read much of the thread but I've just had a response from Monarch regarding my claim.We were delayed for a very uncomfortable 8 hours returning from Ibiza to Manchester on 12/07/08. We appear to fit the exact criteria to make a claim and I used Martins template but they have sent a generic rejection Email. They say the reason is (amongst the fluff!) 'In this case, more than 6 years have elapsed since the flight of which you complain. I am therefore unable to agree to your claim for compensation.'. This sounds like nonsense to me! Does anyone have any guidance as to the next course of action?0

It's not nonsense: it is absolutely correct. If you read a bit more of the thread, you'll see why. But the short of it unfortunately is that you have no further recourse as you have left it too late.0 -

Thanks Vauban. I followed your guide and and sent TC notice of action and received this response:
Thanks so much for being patient whilst we investigated your recent enquiry about your flight and previous claim with Thomas Cook Airlines. I am pleased to say that we have now completed the review of your claim for flight TCX7206
As you are aware, the previous investigation showed that the cause of the delay was as a result of a technical fault which was not inherent in the normal course of activity.
A recent Supreme Court decision in the case of Huzar vs Jet2.com, has resulted in a change to how EC Regulation 261/2004 is interpreted. This is the Regulation that provides for compensation payments for flight delays. The decision of the Supreme Court now stipulates that a number of technical incidents leading to flight delays can no longer be classified as extraordinary circumstances. This is different to previous guidance from the CAA and other national enforcement bodies.
Following this review, under EU Regulation 261/2004 compensation is now payable for your claim. Due to the high workload that we are currently experiencing, I want to say sorry for the delay in issuing the compensation for your claim. You will receive the compensation within 28 days and the amount being paid will be confirmed on your payment confirmation email.
I’m really sorry that you experienced a delay on your flight with us. It’s so important to us to make sure that your flight is on time and you get the best possible customer experience. Thank you for taking the time to contact us and we look forward to welcoming you on your next holiday with Thomas Cook.
