Hi all
I started my case last year with Virgin who used the extraordinary circumstances rule. They came back early this year saying that they are waiting for the appeal hearing and my new letter states that the flight I am claiming for is over 6 years old. Do I forget this or is my claim based on the fact I opened the case within the 6 year time frame.

6 years is the deadline for starting court action. Did you "open your case" with the court before this time, if so your case should still go ahead.
If your contact before the deadline was with the airline only and not the court then you are too late0 -
In April 2014 myself, my wife and daughter were flying Kenya Airways LHR to Nairobi, then on to Mombasa. The plane took off at 20.00 and flew as far as Dover, and then returned to Heathrow where we were given overnight accomodation then again in Nairobi as we missed our connecting flight. We arrived at our resort hotel 1 day late.
We claimed €1800 compensation from Kenya Airways in April, but it we were turned down because the fault was claimed to be 'exceptional'. Following the UK Supreme Court judgement in the Jet2 case, we resubmitted our claim and they offered £1425 which we accepted. We received this amount today in our bank acount today!0 -
Flight delayed over 5 hours, 2011. We submitted a compensation claim last year but we're turned down by Thomas Cook. Resubmitted the claim after the change in the law following the UK Supreme Court Judgement and have just been awarded £640.
Thomas Cook initially offered compensation in a holiday voucher which we refused to accept. Thomas Cook have now agreed to pay the compensation amount in cash into our bank account. Thank you!! Money Saving Expert.0 -
Hi there, is there anyone who can give me some advice or help?
I'm due to travel with my son (3years old) on the return leg Stockholm to Lisbon on the 28th Dec. I have today received an email from TAP saying that my flight has been cancelled as TAP are striking 27-30th Dec. They asked me to call them so after 10 minutes waiting on the phone spending my money I'm told that the only options are that I can change the flight date to the 26th Dec or 31st December or to get a refund of the return part of the journey only. So they want to ruin my Christmas or New Year and they 'are sorry for the inconvenience'. Unfortunately they are the only direct flight operating this route.
Do you think I am entitled to any compensation. I have not decided what option to take as if I change to the 26th that's my Christmas pretty much ruined with my sons grandparents or if I choose the 31st then I'll get back too late to celebrate New Year. If I take a refund this will no where near cover the cost of new flights with another airline which by the way wouldn't even be direct as TAP are the only ones who do direct on this route.
Please some one help with with this mess. This is the 3rd time TAP have done this to me this year.

Unfortunately, due to the fact you were informed over two weeks prior to travel, I believe that what TAP have told you is correct.
I say unfortunately because I don't think the regulations adequately cover this type of incident or the inconvenience it causes.

Hi,
i was wondering if i could have some advice please? I caught a flight from Birmingham international to Amritsar via Delhi on air india. The flight left on time, but during the journey a lady on the flight became unwell and we had to make an emergency stop in turkey. We remained in Turkey for 9 hours and as you can imagine we arrived in Delhi late. As a result of the delay, we were told there were no more connecting flights to Amritsar that evening and we were not offered hotel stays, food etc and instead were put on a coach to Amritsar. What would have been a 45 min flight became a 9 hour journey by road in a uncomfortable coach. In all we arrived in Amritsar almost day later than expected, with little compassion from the airline. Im not sure we can claim compensation as i am sure the airline will say it wasn't their fault but not offering us hotel stay and a flight the next day is such poor customer service. The journey was to take my grandmothers ashes home, so you can imagine the emotional time we are having. I don't expect the airline to take this into account, but i wonder if we could claim some compensation??
Any advice would be really welcome.

assuming this was a passenger and not a crew member that became ill then no compensation as will be extraordinary circumstances. You should check and see if your travel insurance pays anything for delays0 -

Just to clarity, are you saying that IF it was a crew member that became ill it could possibly NOT be classed as an EC?

I think any in-air illness (passenger or crew) requiring a divert would be classed as extraordinary.0
