  • Hi, just heard the great news about the new ruling, result!
    Now then, I've had a claim with Thomson's for a flight to Sri Lanka in 2006 which was delayed by 24 hours, which I started a couple of years ago. It was thrown out by Thomson's after a couple of appeals, and also the CAA said they could do nothing and to try Thomson's again. I've had a letter from them saying they are no longer going to look at this case and they consider it closed. Now the new ruling states that you can claim up to 6 years, but mine is now 8 years, but when I started all this it was within date. Any chances that as I started within date that I could pursue this claim?

    In a word, no. Unless you actually started legal proceedings with submission of court papers.

  • Due to cabin crew strike, we were put on an earlier flight and lost a full day of our short break. Also the flight had a stopover although we had booked a direct flight. Details : TAP Portuguese airline, flying from Lisbon to London, instead of a late evening flight we were put on a 7am flight via Madrid. What should i claim for and what are the procedure of claiming. This happen on 30 oct 2014.

    Just like to say thank you to the guide and template on the MSE delay flight page. BA have awarded my wife and I 250 euro each compensation after a delayed flight from Rome to Heathrow from 13 Sep 2013.:T:T:T:T:T:T
    It was certainly worth a 10 minute alteration to the template and the guide to the points of contact.

    Just waiting to see if Thomsons do the same after a +7 hour delay from Cancun to LHR on Tue 16 Sep 2014...... I won't hold my breath....:(:(
  • We had over three hours delay on a chartered flight with British Airways to Istanbul in 2011. This was arranged by Spirit of Adventure for a cruise. I have the cruise confirmation but nothing else. Is there any chance of a compensation claim here.

    Depends on the cause of the delay. See my guide (details below) for how to claim successfully.

    I hope someone has an answer to my question.
    At the beginning of March this year, I was returning from a trip from Benidorm to Newcastle. On arriving at Alicante airport, we were informed that our flight to Newcastle was cancelled, without a reason being given. On enquiring at the Easyjet desk, we were advised that the next available flight to Newcastle would be 5 days later and that they would put us up in a hotel in Alicante until the next flight. I advised that this was not an option as I had work committments and enquired what other options they could give. They advised that they could put us on a flight to Gatwick and then we could purchase a flight with themselves from Gatwick to Newcastle. I asked if the cost of this flight would be refunded, which they replied would be. This was the option I took and incidentally the flight to Gatwick was also delayed by 2 hours 35 mins. I paid £187.98 for two of us to get a flight from Gatwick to Newcastle with Easyjet.
    After a lot of delaying tactics on behalf of Easyjet, they eventually advised me they were going to refund me the flight cost of £187.98. On the 27/09/14 they asked for my card details to pay the money to me. I still havent received this due to their so called technical problems. I then read about flight cancellation refunds, so I duly sent Easyjet a letter that i got from the internet asking for 800 Euros in total as compensation for the cancellation. Easy jet sent me an email advising that they were going to pay me the 800 Euros as I was entitled to this and also apologised for the delay in not sending me the £187.98 for the refund of the Gatwick to Newcastle flight, and asked formy card details, yet again. I sent them my card details, being overjoyed at them admitting liability.
    I have now received an email from Easyjet, which i have copied into this post:

    Having checked your booking, I can confirm that your are eligible for GBP 187.98 for the alternative flight you boarded to reach Newcastle. In accordance with Regulation EC 261/2004 since we are already paying the alternate transport expenses this amount will be deducted from the compensation amount. Therefore, you will receive EUR 800.00 in total out of which GBP 187.98 will be paid for the reimbursement and remaining balance which comes up to EUR 560.13(as per today's exchange rate) will be paid as compensation.

    My question is, are Easyjet, once again trying to get out of paying what they should do?

    If I had of received the refund of £187.98 earlier, I would have still put in a compensation claim for 800 Euros as the template letter advised. Easyjet had already accepted liability and are now back tracking, reducing the compensation by the refund.

    Is this correct? If it is I will duly accept this.

    Please help with my enquiry.

  • Our first delay was due to a missing passenger but after flying for about an hour we had to return to Heathrow. We were told it was a technical fault and then that the flaps were not working properly. At Heathrow we had to wait on the plane for two hours whilst another aeroplane was made ready. No food was available.

    Were you actually delayed by more than 3 hours from your original flight arrival time of Allicante to Newcastle? If so you are probably due compensation. You asked for rerouting which they are obliged to do. You shouldn't really have ahd to pay the 2nd leg of your rerouting in the first place. Read thru the regulation and you should find the relevant section. IMHO, they are BS you.
