It doesn't but if it comes to the crunch, a judge has to decide and he/she might say that "on the balance of probabilities" if all the passengers, apart from your party, were aware then they did send an email. Worth seeing what a no win no fee fim says; it's certainly not clearcut.
Did they have a phone number? If they did and they didn't try to call you, that should be in your favour.
I had contacted them twice on the same number - once to alter the booking and secondly to have my details resent for the flight (again, hypothetical, but surely someone should have seen from my booking that this was no longer a flight path - I rang only a day or two before we were due to leave). It wasn't part of the sign up details I dont think, but I did contact them via phone0 -

Hi everyone, looking for a bit of advice if I may...
I'm trying to claim compensation for a delayed flight in 2009 from Glasgow to Toronto airports which was delayed 3hrs and 23mins. The issue is, although we've traced the flight number etc, we don't have boarding passes and my mil (who booked the flights for the group) can't find any documents relating to this flight. She has contacted Thomas cook where she bought the tickets and they apparently can't trace it either. Is there anything we can do or should we just forget about it all?

In July this year my wife and I were delayed 295 minutes on a Ryanair flight from Manchester to Faro. Their website indicates they will not give compensation for this massive delay. Anyone suggest a ay to get compensation, or at least how to apply for some.0 -

Sorry I should have added...
I checked the links before and it says we should add in the proof but we don't have any. When we have initially contacted them, TC said they couldn't find us so need boarding passes etc. I don't know whether this is essential or whether this is a delaying tactic. I can't find anything in the links to cover this but if anyone knows where this is, feel free to link for me to see.
