    I complained to Virgin Atlantic last year regarding my 4 hour delay in 2008 and they replied stating the delay was not their fault and was beyond their control. I wrote to the CAA who replied in October that due to new EU regulations they had passed my case back to Virgin Atlantic to deal with.


    Having heard nothing for several months, I again wrote to Virgin, who replied recently to advise me that I had now passed the six year deadline and they would not have to deal with my claim.... The CAA say they can't help as I have passed the deadline...
    Nice work from what I would once have thought of as a reputable company....:mad::mad::mad: What do I do now??

    Nowt. You allowed the airline to talk down the clock, and you've now effectively forfeited your claim: if you don't start legal action within 6 years, that's it.
  • Does the EU ruling apply if my flight started in london europe and ended in Kansas USA. my connecting flight which went from washington to kansas was delayed for over 20 hours (plane door wasnt working properly). does EU ruling apply to my connecting flight because my journey started in europe and was all booked with the same company who's headquarters are based in usa.

    It is a matters of some debate (there's a legal judgement called Folkerts, which doesn't really clarify). Look at the US thread - loads of discussion there.
  • Hi, I've just got back from Zante, booked through Olympic but the flight was with Smartwings. We should have flown on Sunday 14 September but due to a bird strike our flight didn't take off until 5.30am on Monday 15 September. The flight number was QS 3073 from Zante to Gatwick but I can't find any details of it on flightsats. Do you think we have a grounds for a claim? Any advice would be greatly appreciated. Also, despite asking repeatedly we have not been given anything in writing regarding the delay.

  • we were delayed 5 1/2 hours on an easyjet flight to europe , used the MSE template and it worked a treat , ( best to send it tot he CEO in the first instance as this circumvents the Customer service snarl ups. It is probably best to note that Article 7 of the EC REg 261/2004 ( easily downloadable from the intranet) refers to compensation for the delay e.g. the Euro 250 for short haul europe , but I'm still fighting for the reimbursement for the Article 9 reimbursement- reasonable expenses and meals - there has been the usual attempts to say the Regs specify a sum, but all they appear to say is free meals appropriate to delay ( or something to that effect) and things need to be reasonable - hopefully Easyjet will now take appropriate advice on the applicable regulations and make payment that is reasonable - £3.00 for lunch at an airport is anything but reasonable - Good luck with your claims and thanks MSE for the template

    I've tried to contact the FlightStats website to find out how I can use them as mentioned in the MSE blog post but they just refer me to their terms and conditions saying "Our terms and conditions prohibit the use of FlightStats Services or the FlightStats Data for any passenger rights claims actions, for example actions pursuant to EU Regulation 261/2004"

    Does anyone know of a way of checking delays on on old flights?

    Any help would be greatly appreciated :T

    Flightstats is the place that you can look for details. You need to do the searching yourself by checking routes and dates. What they are saying is that you cannot use flightstats data in court but if they have reported accurately then the flight was obviously delayed and the airline would know that.
    If you register you can then search...I assume you had a number of flights that you know about (routes and dates) but cannot remember which one of these was the delayed one
