Thanks for the information Vauban - in my defence, United refused to give us a reason until now of why the plane had been delayed. I have of course read through every relevant thread on this forum including your own guides, before sending the court forms, and now you mention do recall Walletin, but haven't studied in detail all of the cases until I knew what I was needing to gen up on. I literally had half an hour between opening the letter and having to go to work and was just after a quick bit of advice! I will be getting very familiar with Walletin during the weekend.

Good-o: I would just hate to see you turned over by a smart airline lawyer because you hadn't done your homework!

Hopefully you've seen this too: http://db.orangedox.com/GdfSa4xUZdZI5GJadr/Vauban's%20Guide%20to%20Claiming%20Flight%20Delay%20Compensation.pdf

Hi - would appreciate some thoughts. Flight to Newark delayed by 7.5 hours on 5/4/14. Once boarded Captain announced that delay was due to the fact that working time regulations in the US had changed the previous week and this meant that he and the crew had had to take a longer rest break, which had not been reflected in the scheduling of the flights. Have complained to United quoting the relevant legislation. They have replied saying that the delay was due to an 'unexpected safety shortcoming.' and is therefore not covered by EC 261. Have tried to fob me off with useless vouchers. Anyone know how to prove they are fibbing! Thanks in advance.

Egalsoarin, I sent you a private message as I was on the same flight as you and have started court proceedings.

Compensation would only be due for Kenyan Airline flights fo journeys departing from the EU
If the delay was on the Paris to Manchester leg (eg you arrived into Paris on time from Nairobi) then you would have a claim for that leg. If you missed the flight in Paris due to delay from Nairobi you are out of luck
You could try your travel insurance so see what cover you have for delays from them
  • Hi all, newbie posting so please be gentle.

Used the excellent guide to take KLM to task for flight delay but despite claiming 400 euros they have offered 200. Their reply to my follow up was:

"May I explain that, according to EU recommendations, airline passengers are entitled to compensation in case of delays over 3 hours - unless it was caused by extraordinary circumstances over which we could not exercise any influence. For a flight of the distance 1500km-3500km which is delayed by over 4 hours, a passenger is entitled to EUR400 in compensation. However, for a flight of this distance which is delayed by more than 3 hours but less than four hours, the compensation entitled is reduced by 50%.As I understand from your email, you were less than 4 hours delayed and therefore we deducted your compensation by 50% from the full compensation amount of EUR400.Therefore, you received the amount of EUR200, which is equivalent to GBP160 in your local currency. In light of the above, I can confirm that the compensation payment you received was correct."

    Is this correct??
  • Just wanting some advise! I've sent letter to Thomas cook and had reply advising due compensation but instead of cash they are offering me money in form of voucher.
I don't really want to fly with Thomas cook again and the compensation is suppose to be in cash.
What do I do now! Thanks

    Think through your options:

    (1) Accept the vouchers

    (2) Ask for cash.

No this is quite wrong - compensation is reduced by 50% for flights delayed by more than 3 but less than 4 hours: but only on journeys greater than 3500km (ie from 600 to 300 Euros). Tell them this, and that you will start court proceedings if they do not pay the full amount (you have them over a barrel!).

The delayy was from Nairobi to Paris as captain decided to delay leaving Nairobi due to tailwind and ended up being 40 minutes late in to Paris which then meant we missed our flight from Paris to Manchester and without consultation we were then booked on to next Air France filight 5 hrs later .They would not book us on to other airline such as ly be as not alliance partner hence we were delayed in getting home by approx 5 hrs
  • Hi, hope someone can help, this is the first time I have been on here :j I sent my letter off to easyjet to claim compensation for myself and 9 family members. I got my response fairly quickly saying we were entitled to 400euros each. They arranged to call me to take payment details as the card we originally used had expired. They called me on 14th August and we haven't received any money back yet. I have emailed them but have had no response. Is anyone else still waiting almost a month later for payment?
    Thanks in advance
