    Wheela75: This depends on whether you were on one "through" ticket, or two separate tickets booked through the same agent. This can happen if you go through third parties. Was your luggage booked all the way through, or were you expected to collect it at Madrid and re-check in?

    If it was two tickets, you have no claim under 261/04. If it was one ticket, I think BA would be liable, as they caused you to miss the connecting flight. But others will have a view.

    Bear in mind that BA and Iberia are effectively the same airline owned by IAG so technically it is a single airline thru ticket?

    I can't say for sure I have a one PNR number, but I never actively looked for separate flights. I have the original booking document with a single order number and the summary of the flights are booked as LHR-LIM on the summary.


    The bags were checked through to Lima, they told us we only needed to pick our boarding pass up from Iberia. Although I still remain confused by this!


    I think based on what you have said (and the indication by LAN that they passed the details onto BA when I first complained) I will have a crack at BA.

  • I recently submitted a claim to Monarch Airlines for a delayed flight from 2010 for my family of 4. As I guess is the case with all airlines they asked for copies of booking references and boarding passes. I, like most I guess, didn't have these as the delay was so long ago. I completed the claim form and sent an accompanying letter to advise of this and that they should review their retained passenger records for confirmation. Monarch replied by return advising that the claim would be processed without any fuss. It would have been easy to accept that a claim is not valid without the documents but this is not the case. Hope this helps if you are in the same situation

    Should be on Monarch thread and your experience does not echo the response 99% of delayed Monarch customers receive from this airline. From your post I presume you have been paid out in which case a suitable post on said thread may help others and a post here >

  • Having watched Martin Lewis on ITV about a month ago talking about flight delays I decided to submit a claim toThomas Cook.In july 2010 a party of 4 of us had a 6 hours delay to Cyprus from Manchester.It has only taken 3 weeks and I have now received an holiday voucher for the sum of £1420 (£355 per person).Iused the template supplied on this site and have not had to send any proof ie boarding passes etc.Iwould advise if possible to check length of delay on such as flight stats and check distance you travelled which again is available on the internet.So thanks to Martin Lewis for the advice.

    I'm a bit pragmatic about this.
    Yes cash is nice but some airlines will offer more in vouchers than the statutory cash amount as ultimately it costs them a lot less.
    If you are intending to travel within the next year with the airline anyway AND the particular airline's voucher doesn't have lots of restrictions that might prevent you using it a voucher can *sometimes* be a better deal so not to be dismissed outright but check which is better for your own situation.

    If the airline is proposing to offer you more in vouchers, perhaps (though I think you have to triple check the T&Cs - and also recognise that your plans may change ...). But I don't see much evidence (bar one or two non-UK airlines) of that on here - the voucher offer is generally for the same amount you would be entitled to in sterling. In these circumstances, of course, there is no advantage in not taking the money.
