What two wrongs are you talking about Ich? The CAA's blatant refusal to enforce the Regulation, andthe airlines' cynical attempts to evade its responsibilities, presumably?
I'm not aware of any other "wrongs" on the passengers part - it is not wrong, for example, to expect airline to adhere to the law and not lie to passengers in an attempt to prevent paying statutory compensation. That doesn't strike me as wrong (or unreasonable) at all. But no doubt you will enlighten us ...0 -

As Kevin Clarke's comment regarding Huzar I just throw in this one which hits home regarding the CAA/NEB dreamt up list ... “Hopefully this judgment will provide even more certainty to the European Court of Justice cases we already know of, and will add more clarity to the situation which the Civil Aviation Authority have only confused with their misguided, legally incorrect and one-sided “list of extraordinary circumstances”.
And Ich my claims have been all about the money and the charity I have donated the "Monarch money" to have been very grateful - actually I was out of pocket as I had two days in court, my travel costs, court and hearing fees and my 'win' - in total went straight to the chosen charity so in my case it definitely was not all about the money (hence the reason I still stick around as well) - it is just getting the airlines (and the CAA) to recognise 261/2004.0 -

Ich: you misunderstand me. My comment related to your apparent (if unsubstantiated) concern about the unreasonableness of claimants when they have been faced with the most extraordinary behaviour from the airlines and the CAA. It seems oddly misplaced.
But to answer your question directly, I do not think that anyone should approach this issue unreasonably. However nor do I assess that you have demonstrated, to any degree of credibility, that claimants have behaved unreasonably. Where's the evidence? Show me the beef!0 -
I'm not suggesting that the claimants have been unreasonable, I'm trying to suggest that the way some of the advice given on this site by the "regulars" is however.0
