Morning everyone. New to MSE so i'd appreciate as much input as possible.
I'll try and keep things as brief as possible, just wondering if you think I still have a case in applying for compensation?
1) Due to fly from London to Brisbane via Kuala Lumpur.
2) Malaysia Airlines delayed by 12 hours due to a technical fault with the A380 aircraft
3) Transferred to Singapore Airlines and flew out approx 6 hours later.
4) Singapore put us up in a hotel for 9 hours but then lost our baggage on arrival in Brisbane.
5) Overall, we lost 12 hours (full evening) of our holiday
6) Submitted comp claim to Malaysia - Rejected due to Exception Circumstances
7) Appealed to CAA - waited a year - Rejected.
I still have all the relevant information , lost baggage receipts etc to support my claim.
What do people think? Am I right to be asking for comp here?

Depends on the nature of the technical fault. Was it something that has affected other A380s - and perhaps saw the whole fleet temporarily grounded - in which case this would likely be extraordinary. Or was it a more run of the mill technical failure, which is unlikely to be extraordinary.
What did the CAA say in their rejection of your claim?0 -

Took me 6 months via NorthamPton however you may wish to ask Vauban as his claim (also against Monarch) is now due its 3rd hearing but success is close (I hope!).0 -

I started my claim in January of last year, but I'd be surprised if this was typical. On average, about 6-8 months, I reckon.
Of course, unless your delay was around the spring of 2012 (and thus getting close to two years), my instinct now would be to hold on until the Huzar and (if more than two years ago) Dawson appeals are heard in May. If both go well, I suspect many airlines will stop fighting the inevitable, and bringing a claim may be a lot easier.0 -
My delay was June 2012 claim was issued in Dec 2013 I suppose I will just have to wait an see how things develop0

I suspect they are now putting funding aside for this with a new Financial year not far away. Looking at this thread more are being paid out than ever so something must be in the works. Lo and behold i've got home last night and can't find the letter anywhere. I got it in the midst of a house move and must be lying arund somewhere...
From memory it basically said it was limited to that one aircraft and that it would be classed as an exceptional circumstance.
Here's an extract from the response Malaysia Airlines sent to me:
"Concerning your flight delay, the inbound flight MH002/05November Kuala Lumpur/London identified a potential fault with the aircraft and it became necessary to delay the flight so that an inspection could be carried out. This was totally outside of Malaysia Airline’s control and could not have been avoided. Due to the nature of the technical issue, our engineers took the decision to swap aircrafts to minimise the delay for the London passengers. Our primary aim is to ensure our customers reach their final destination safely, Malaysia Airlines are exceptionally diligent with matters relating to health and safety, and exceed safety standard guidelines to ensure the safety of our passengers and staff on board every single aircraft."
