    Vauban, I am known for my tenacity, have plenty of time, have read all the posts and have done my homework. So please don't insult me or judge me just cos I don't remember every acronym in a world full of them.
    Not sure what you mean by "talent" but I have managed my own life and businesses for decades so won't be hiring a solicitor either (and I do know what NWNF means) when I can do the job myself and claim ALL the money, not some of it. Is that what you did / are doing ?

    Of course I won't insult you, Morgana: my role here is to be helpful, but also to speak plainly. I hope that someone with your tenacity will respect that.

    I have not engaged a NWNF lawyer, but am doing this all myself too. And I too have read all the posts, which is how I acquired my knowledge of this funny business.

    If you are confident you are across the law - and the process - then go for it, and good luck!

    With respect, you wouldn't be asking that question if you'd read ALL the posts.

  • A couple of weeks ago my Mother had a delay with Thomas Cook on a flight to Dalaman in Turkey. We sent the necessary letter and claim Thomas Cook who responded within the allocated 14 days - wonderful.

    However they have coughed up the 348GBP as within the guidelines but in the form of a HOLIDAY VOUCHER (pretty useless as she works within the Tourism industry and very rarely goes on holiday).

    Do we have to accept this or can we ask them for cash? I haven't seen anyone else offered vouchers seems people got cash.

    Any help greatly appreciated.

    A question for you

    If an airline swaps planes around on flights due to a technical fault and thus delays your flight because if it, can that be described as being beyond their control or not and thus avoid compensation payments?

    I fly regularly between Luton and Budapest with Wizz. When I arrive for the flight, always the 2.25 flight, I always check to see how the inbound flight is doing so I can let my partner know what time to expect me at home in Budapest. When I arrived. I could see the flight was more or less on time, so I let her know that I shouldn't be delayed.

    Just shortly before the gate was due to go up, a delay of an hour was put on the flight, which I thought was strange as the inbound flight was about to land. When it had landed, I went to have a walk past the gates to look for it, and found it at gate 16. I knew which aircraft it was from the flightradar24 website, which I use to track the flight on the way in. At the gate, our flight was also up on the screen above the gate, but still showing as delayed on the main information screen. I had also seen that another wizz flight had been cancelled earlier in the day, and notices a couple of mechanics putting on their overalls under a wizz aircraft on gate 21. Then I went to have a drink at the bar at the far end of the airport where it is a bit quieter.

    I sat wilting for the hour to elapse wondering what was going on, and then walked back to gate 16 so I could be first in the queue to board before the gate was announced, but the inbound flight had left. Strange, I thought. So I went back to ponder and then realised that the aircraft on gate 21 must be the one that had been allocated to our flight, and that the two mechanics I had seen putting their overalls on must have arrived from Budapest on the inbound flight that had arrived on time. So, I looked up the aircraft being repaired, and it turned out that it had arrived at 7.30 that morning from Warsaw, and had been there ever since.

    Finally.after two hours delay, the gate was announced as 21, as I had suspected, and so I went over there, and arrived just as one of the gate staff was explaining that the aircraft on our flight had a technical problem, and that they were working to fix it. I pointed out that this particular aircraft had been there since 7.30 that morning, and that our flight shouldn't have been delayed as the inbound flight had arrived on time, at which point they admitted that our aircraft had been used for the morning's Budapest flight, which had been delayed until the our aircraft had arrived. When I pointed out that this plane came in from Warsaw, I was told That was not correct, so, in other words I was telling a lie. They then announced a further delay to the fight and that they would be issuing a refreshment voucher. Just as they started doing this, the gate staff got a message form the captain that the repair was done, and we all went back to the gate again, when after an hour of standing around while a ground run was carried out, we were boarded and the flight departed 3 and a half hours late.

    It made up some time on the way to Budapest, and we touched down with a delay of 185 minutes. We were not given any free food as we should have been down, as the attendants claimed that Budapest was over 1500 km, and so should be subject to a 3 hour cut off, although it left 3 and a half hours late. According to the mileage calculator I found, it is in fact only 1492 km, so food vouchers should be provided after 2 hours.

    So, while I can understand that a flight is delayed, can an airline by swapping aircraft around use the safety excuse or not? Obviously, they chose to fly in the mechanics from Budapest with the spare hydraulic pump rather than get a local company to fix it - but they knowingly put am already faulty plane on our flight and hoped to get it repaired and back to home base in Budapest before the 3 hour delay time - and had we had a straight in approach, rather than having to come in to land from the south would probably have got away with it.

    Do I have a case to claim? opinions?

    This is an operational decision, firmly within their control. Not extraordinary at all. But it is likely to require court action all the same.

    There are extensive aircraft maintenance facilities at Luton Airport, IMHO it would be a "reasonable measure" for Wizz to have in place an agreement with one of these providers to minimise delays to less than 3 hours.

    First off, traveled with an international airline 'Airblue'. Flight was from Birmingham (BHX) to Islamabad (ISB) (Distance : 3934 Miles approx). I am trying to determine whether i can claim for compensation as described below ;

    Delayed departure flight.
    The flight from BHX to ISB which was scheduled to depart at 22.30hrs but actually departed at 01.06hrs the following day. The delay was under 3 hour rule.

    Cancelled return flight.
    I had a call from the airline to inform me that my flight was cancelled and was offered an alternative date which ended up cutting my holiday earlier than expected.

    Can i claim compensation for either the events that has happened?

    If delay on arrival in Pakistan from UK was less than 3 hours, then no.

    No claim for return cancellation, as it is a non-EU airline flying from a non-EU airport.
