Well don't lose sight of what was bargained for - a departure and arrival time are part of the contract. Although both of these may be estimates, it is now part of English law that if those estimates are out by several hours, compensation must be paid (once a few more boxes are ticked).
You'll find advice to issue s.75 claims for 261/2004 liabilities on several solicitors' websites, and the consumer organisation Which? has a team of in house solicitors, and of course they publish a template letter for consumers to claim for delayed and cancelled flights under s.75.
I agree the banks will wriggle, but that's not a reason to walk away from a valid claim.0 -

I mentioned delay compensation to a couple of solicitor friends I know:
One mentioned whether ATOL / ABTA have a conciliation scheme for these issues (for package holiday delays I assume?)
The other said it would be good to get a view from Trading Standards before proceeding to small claims court.
I wondered if this sounds relevant or if you had tried either of these routes?0 -

ABTA told me they werent responsible and to go to the CAA0 -

hi my husband and i were delayed back in december 12 just found out today we are getting 400 euros each
originally told we would get nothing, they then changed it two weeks ago to you can have your meals and prebooked seats now we are getting that and 800 euros
not bad going plus cheque is in post
so 6 weeks since back holiday and we are just about solved
once cheque in bank i will be a hap[y lady
they wanted to give us the euros in holiday vouchers however we have swung it into cash so getting 712..12 which i think is not bad plus 30 odd for other stuff:A VK :A0 -

i had posted them earlier in december, we were due to get a flight home from tenerife to glasgow on 16th dec when plane landed in tenerife emergency chute opened meaning 70 passengers were taken off place and told we were being redirected some to manchester some to birmingham then getting bussed up to glasgow, worked out we arrived 12 hours later than we should have
so due to the distance we come under the 400 euro mark:A VK :A0 -

Feb 2005 is for whole of Europe but subject to time limit of each separate country. In UK you have 6 years from date of delay/cancellation in which to negotiate and be paid compensation or failing that to submit a claim to the Small Claims Court. If your flight was February or later in 2007 you have time to submit a claim if you are very quick.
