I was answering your question in #4861.

As for your question in #4856, I don't know the answer about the inheritance of liabilities, but that is a standard commercial principle (assuming they did take over the company in its entirety).

As for records, the onus is on the company to explain why compensation is not due (assuming you can prove you were on a flight that was late). So their failures of record keeping are their problem, rather than yours!

    Thanks!
They're saying they won't pay comp because they have no flight record for this period

Do you think that's just a "get lost" excuse?
Posts are not advice and must not be relied upon.
  • Our flight was delayed by 4.5hrs from Tampa as the incoming jet had gone tech, hydraulic leak apparently! I believe that plane left 5.5 hours late hence our delay.

Does this entitle me to comp?

  • Finally got a response from Jet2 today, after me sending a 2nd letter.
They say they are not willing to pay up, as it was an "extraordinary circumstance".
I didn't think going tech was an extraordinary circumstance?
It was for safety reasons blah blah blah.

I don't really know what to do next. I would have to write to the relevant people in Greece now, and I do wonder if I will just be wasting my time. Or should I just go straight to the Sheriff Court and file a small claim....

Any one got any advice? It would be more than welcome.
    TIA

    Think so!
Eastern Airways bought over Air Southwest.
Can't see how it's different to the BA BMI situation?
I'm not going to give up.
They're liable - not my fault they have no records - though I don't believe that this is the case

has anyone ever got any think back from ba from outside the eu

i had a flight delayed from Tampa to Gatwick for 24 hrs in july they did put me up in a hotel etc but still was a pain

some said it was because of too much traffic flying into Gatwick due to the Olympics others said that ba were short staffed

was going to complain to ba in writing but i am yet to see any success stories so far so guess i would be wasting my time
