Now had the usual reply from TC exceptional circumstances. The flight was TCX 7175 from Corfu on 08/10/2012, delayed by 9hrs then diverted to Cardiff. I am now trying to find out the exact cause of the exceptional circumstances. Tried ringing but the lines are exceptionally busy & they cut you off0

Rescheduled or not (especially at such short notice), it was still delayed by more than the statutory limit for compensation to kick in.
I was reading it that the rescheduled flight was due at 17.00 (ish) and the actual arrival was 19.00 (ish) - so only 2 hours late?
But the flight would have had to have been rescheduled giving less than 2 weeks notice if thats the case?
The original flight was due to land at 11.35 but when we arrived were informed of 8 hour delay. Then they must of rescheduled it for 17.00 (ish) landing whilst we waited at cardiff airport.
Is this info on flight stats a good or bad thing cos not sure what u mean.0 -
Simon, the only place giving this change of scheduled arrival - so far - is flightstats. I would go by the actual paperwork that is forthcoming from Charter Travel.
In the meantime, an email to Monarch customer relations at:
customer.relations@Monarch.co.uk
simply asking the reason for the delay, as you are considering making a claim for flight delay compensation, but do not wish to burden the department if the reason excludes claims, is the way forward.
Obviously include dates and flight numbers and stuff.
Only then can you decide whether to proceed with the form filling.
But I doubt very much that the explanation/reason given will be "It's our fault, please go ahead and claim" if you know what I mean.0 -
Has anyone had any dealings with US Airways?
Had a flight in September 2008 from Manchester to San Fran, connecting via Philly. Delayed Departure from Manchester resulted in an overnight stay in Philly before finally getting to San Fran the next day.
US airways are saying that the flight into Philly was only delayed 92 minutes and no compensation due as EU 261/2004 does not count between internal flights in the US. My ticket destination was San Fran. They must be wrong?0 -
I rang Thomas Cook to give them chance to tell me what the extroidinary circumstances are, still waiting to hear back from them. After my initial call they rang back to inform me that they could not even find our names on the passenger list. Don't think they are doing anything but send rejection letters out, but I will fight. Funny how they make a loss but Thompsons have made 390million profit in the last year0

Now had the telephone call from TC.the fault was a FAC 1, does that make it extroidinary circumstances0

They are putting it in writing, with a cheque for £27 for not giving us the welfare we should have had at the Airport, or we could have had a voucher for £500

I have recently submitted a claim for flight delay compensation against Iberia. Our flight from London Heathrow to Lima via Madrid was delayed for more than three hours back in 2008. Whilst the 1st leg of our flight to Madrid arrived in time the 2nd leg from Madrid was delayed after our take-off was aborted. Following this our plane was parked on the runway apron and we were prohibited from leaving the plane. We were not provided with any meals and only had access to a water fountain. A technical problem was given as the reason for our delay. Iberia have responded confirming that the delay was indeed as a result of a technical fault however they are claiming the defence of an extraordinary circumstance. Whilst I fully intend to argue against the use of this excuse I would like to know what enforcing authority I need to contact should I not receive a satisfactory response. Would it be the CAA or because the delay resulted from the 2nd leg would I have to contact the Spanish equivalent?0

Thanks for the reply Centipede, would the proceedings have to be issued in the Spanish equivalent to our small claims court or could we take action in the UK?0
