... If most airlines blame technical faults on extraordinary circumstances...what on earth would anyone ever be able to claim for where they pretty much bend over backwards to help you. I cannot think of any instances...

Has anyone had any response from Thompson since the ruling?
I wrote to them a year ago but they fobbed me off whilst the ruling was pending.
My delay was caused by, two factors:
My flight was on a Sunday.
1) Original plane went technical in the Caribbean on a Tuesday and got stuck there (it was still waiting for a part on Sunday)
2) The replacement plane needed a fuel stop to cross the Atlantic, so it was constantly running late all week.
I can't see how they could possibly claim extraordinary circumstances in this case, as they had days to get a plane organised.
Fuel stop in Bangor (Maine) was fun, but the comfort of a short haul configured 757, not so much.
But they have yet to respond to a fresh letter, after the ruling.0 -

111KAB From start to finish Monarch have put obstacles in my way and left everything until the last (legal) minute to respond.
I have submitted mine to the court last week just waiting on the papers being served on them... have you thought of making a complaint to the CAA....perhaps the more they get about Monarch...something might happen...
I also posted on Monarch's FB page outlining their treatment of customers... they dont like this:)

My claim was processed with amazing ease:
Sent email to Easyjet regarding flight delay LGW-GLA in March 2010, initially they responded saying Montreal Convention applied and i was outwith timelimit of claiming which they suggested was two years.
Took the matter up with CAA (quick email to them with all the details), 10 days later a responses from Easyjet saying they would pay compensation.
Cheque for £405 (500 euros) arrived today.
Flight was delayed by 3hrs and 30 minutes, due to a computer fault affecting Easyjet at Gatwick.0 -

If so I received a letter last week saying they are still investigating0 -

Because they didn't bend over backwards.
How would you feel if you were trapped in an airport overnight with no food or drink, with a day of your holiday gone and your other half being up for 36 hours straight? Would you just let it go?0 -

I wrote to them over three weeks ago giving them 14 days to reply... Heard nothing.
Sent an NBA letter via Royal Mail Recorded Signed For service (First Class) on Monday... The Royal Mail Tracking system says it "is being progressed through our network for delivery".
As an aside: does anyone know what action I can take with Royal Mail if the NBA letter never shows up as delivered? And would it adversely affect my legal case if I never have any proof that my letters are getting to Thomson?0 -
I have just sent a response to Ryanair. In adddition to the delay I wondered if should it come to court we could claim for loss of enjoyment?
This was a milestone anniversary trip to Venice for us and due to the delay we missed a pre booked water taxi trip a booked celebratory meal, and as we only arrived at our hotel at 5am it seriously impacted the next day. In fact rather than ruin our trip completely we decided not to take our return flight with Ryanair and we booked a flight home with another carrier to allow us an extra day and consequently we stayed an extra night in an expensive hotel. I understand we cannot claim for consequential damages but what about loss of enjoyment of a much planned trip?0
