Looks like no claim but you can still write a letter before action which you can find in Vaubans Guide and see what they say. They usually won't tell you the full circumstances until you have issued court proceedings.

But I really wouldn't bother. That horse is definitely dead.
  • New to this, so please be gentle!

I would appreciate the opinions of the good folk on here as to whether it's worth pursuing easyJet for a flight compensation claim following a recent cancelled flight to Iceland. I've assumed it's classed as cancellation as we were provided with replacement flight, although specially laid on for our flight, which had a new flight number.

Our flight was turned around and returned to Luton just before starting its descent to Keflavik airport due to high winds. In total we were delayed overnight about 24 hours from our original scheduled arrival time.

Reading through the various information available (& unsurprisingly this was also easyJet's response to the claim we logged via their web claim form) it would suggest that cancellations / delays due to bad weather can be classed as extraordinary circumstances & therefore fall outside of the eu regulations for compensation.

However, I am wondering if it is worth pursuing easyJet since:
    (1) Iceland's weather is known to be unpredictable and high winds are not unusual at any time.
    (2) high winds were at play the day before our flight which were higher than the ones experienced on our flight day, and planes landed (including easyJet's)
    (3) all other scheduled flights managed to land at Keflavik airport on our scheduled day of arrival (admittedly some of easyJet's didn't, but similarly some did)
    (4) high winds were forecast that day (& the day before)
    (5) the airport remained open throughout.

So I am wondering whether the circumstance is truly extraordinary since this information could indicate that the winds were neither 'freak' in nature nor 'wholly exceptional'. If other flights were able to land why couldn't ours? And why was it acceptable to delay our flight 24 hours (easyjet successfully landed their early evening flight later that same day).

Am I clutching at straws or is it worth a go (will be of the letter variety & potential court action since the initial claim has been rejected)??
  • They don't have to be freak or or wholly exceptional. Weather related delays do not qualify for compensation. They are outside the airlines control. ATC decides which flights, if any, can land or attempt to land, and which can't. Airlines don't turn back or divert unless they have to. It's more inconvenient and expensive for them than it is for the passengers.

Hi every one, I bought a holiday from an online agent my flight was in the morning and before we board they delayed it due to a technical problem which they couldn't fix then was cancelled and offered us a hotel for next day flight for the same time, we (2 people) didn't go to the hotel and demanded at the front desk to give us an alternative flight which they did and was for same day but 12 hours later, we lost a day of our holiday, hotel and on the flight back, a week later, I fell ill on the flight so it was all doomed from start. Do we get compensation at all..? Flight was from London to Dubai via Doha. Many thanks

On the details you give Yes you are due €600 per passenger. Your claim is against the Airline. Which Airline was it?. Google and download Vaubans Guide all explained in there. There is even a template letter.

Apologies where this is no doubt covered elsewhere in the thread, but it would take hours to scroll back through-not really lazy.

Have looked at various compensation guides and still not clear '

    simple question :

flight cancelled-airline (eurowings/luthansa ) has offered compensation-i am reasonably happy and not being greedy ,but am i also entitled to a refund of the original flight cost ?

( Flight cancelled on day one-i did return home with the same airline on first available flight 29 hours later )

Assuming the airline transferred you to the replacement flight with no charge there is no refund as the ticket was used (would apply if you chose not to travel and make your own arrangements at your own cost)
  • If the put you on a later flight, no, you can't claim a refund for your original flight.

So what's your theory - easyJet could have landed had they wanted to but just for the fun of it they decided to turn around and fly back to Luton?

    Evening All
So ive been chasing a compensation claim with AA for over 10 months now, not got any response. Also took it to the CAA ( via the resolver website)
Anyway the CAA also have not replied ( gave them 7 months). so i contacted Citizens Advice who informed me that although my flight was with AA as i paid for the flight ( plus transfers and accommodation ) through BA is it them who is liable.
I sent BA a message, with a hasty reply of that they are not liable for this.
Can anyone help on who it is I need to be chasing......apart from my tail which seems to be the obvs answer !!!
    Mucho gracias
