If you've already referred the matter to the Information Commissioner, then there is not much else you can do. His staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s. The banks and credit card companies have received so many "black marks", that one more doesn't make any difference. Any other firm would have employed extra temporary agency staff to deal with the extra workload, so that they still met their legal obligations.
In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, all you have to do is fill in the blanks.

If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

Hi
Ive sent the 1st letter to Barclays Bank asking for them to send me my statements,giving them the 40 days & also enclosed the £10 Postal Order but no statements sent to me.
I then sent another letter stating that their time limit was up & gave them another 7 days as a Goodwill Gesture to send me these statements.Still no statements.
What Do I now? Im very annoyed with them :mad: :mad: :mad:

Hi
I am trying to reclaim my bank charges but I seem to be getting stuck at the first hurdle and it is really starting to annoy me. I sent my first letter about 9 weeks ago now, I left it for about 4 weeks then decided to ring them. I was told that they had not received a letter, but I know that they had because I sent it recorded delivery and it was signed for the day after I sent it. Anyway the person I spoke to on the phone said not to worry he would get the statements printed for me and sent to me within two weeks, he was a really nice chap very pleasant, so I thought right ok at least they are soting it now.
Anyway three weeks pass and still nothing so I call again and they say they have been requested and should be with me shortly, at this stage I am a little bit frustrated but am being polite to the lady I am talking to and say I was told it would take two weeks and it has already been three. She said I should not have been told two weeks because it will take about 4.
So now another two weeks have passed and still nothing, I am very frustrated with this already. What can I do they keep telling me they are being sent but I never receive anything. Can I report them to anyone?0 -

I've just read about claiming for an 'unknown amount' if you have waited over 40 days for statements? Ive been waiting over 40 days from Barclays and had a letter saying I now have to wait until the 2nd July due to the backlog :mad:
Is this allowed this LBA for an unknown amount? Have many done it? Only just heard of it

I sent a letter and £20 cheque on the 24th April 2007 requesting six years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the D.P.A. As yet I have not received any correspondence from you.
By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.
