40 days and no info/statements

  • Hi there I have not heard anything form lloyds in the last 40 days what do I do next please.

    New thread as the other one was getting too long.

    To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.

    If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

    You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

    If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

    Yorkshire Bank have had my claim for more than the allocated 40 days now and all i have is a letter saying that they are struggling to meet the 40 day crireria as they have a lot of these claims to process. It also says:

    "Whilst you are within your rights to refer the matter to the information commissioner, I confirm that we shall provide you with the information as soon as we possibly can."

    Does this now mean that they have covered themselves against any complaint or should I still complain?

  • I wrote to BoS originally on the 15th March 2007 with the initial request for the back dated charges.

    I only received a letter from them 11th May which was dated 1 week earlier telling me the information had been ordered and I should receive it within 2 weeks, it's now the 05th June and still nothing!

    That is now 82 days since my original letter, do I have any re-course against them, can i make a complaint that would be upheld to any financial authority?

    The letter I received has no telephone number on it and has come from the Data Subject Access Request Team at Trinity Road Halifax, my branch is George Street, Edinburgh although I live in Birmingham.

    Anyone know which way I can turn as they have taken so long just to not even get the information to me?

    As many others im still waiting for my list of charges (56 days) so I contacted the Banking Code Standards Board.
    They basically said they cant help in Individual cases but would consider a serios breach of code as one that "has affected other customers, has been systematic, has continued for a long time or is suspected of having been deliberate".
    So to everyone else out there whos waiting if you fancy firing of an email to let them know how widespread it is the address is helpline@bcsb.org.uk
    Whether or not it'll do any good I dont know but it cant hurt.

    If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, report the matter to the [URL=“http://www.ico.gov.uk/complaints/data_protection.aspx“]Information Commissioner[/URL]. However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s.
    The acquisition of wealth is no longer the driving force in my life. :)

    Hello,
    Can anyone please advise me on the 40 days response allowance that you have to give the banks to send out your requested bank statements. I applied for mine with Nationwide at the end of April, they cashed my £10cheque on the 15th May 2007. The 40 days (which I thought was from the date of your original request letter) has now expired with no sign of my statements so I have therefore asked Nationwide where my statements were to which I received a response of ....'the 40 days time allowance is from the date that we cash the cheque, this therefore being the 15th May' is this right or are they trying to stall?

    Exactly the same as me, i wrote to them on the 19th of march, they cashed the cheque on april 10th

    (few phone calls)

    Got a letter on may the 8th from trinity road halifax saying the info has been ordered any problems please contact me, but theres no email or phone number.

    Every time i phone up its "thats strange no notes on your account, i'll put a note on your account as urgent and u should get the statements in 7-10 days"

    3 times ive been told this, i wrote the 1st letter on 19th march!
    sooooooooooooooo anoyed at halifax ... i will close all my halifax accounts once ive got my claim sorted and never deal with them again :/

    if they dont responed then you can file a claim for unknown amount, any problems let me know

    How does one claim for 'an unknown amount'?
