What happens when the data protection letter has been sent and the 40 days are up? I know the next step is to report it to the information commissioner for breach, but what will happen after it has been reported and how long does it usually take?0

can someone help??? I have recently decided to claim back my bank charges which are a lot. I sent the first letter from this site asking for my last 6 years statements and they should have been back by 9th june(40 days after the date my cheque was cashed) but have not arrived. I had a large overdraft and have left the account with no arrangement to pay it back at the moment. is this why they are not sending my statements, i am really scard by all this and dont know what to do or who to contact but i am in big debt and need help! please can someone advise??? my bank was Abbey0

It is coming up to 40 working days now and I have still heard nothing. Does anyone know what do I do next? The bank is HSBC....Our dream has come true...0

I requested details of charges last month. Officially the 40 days are up tomorrow and today I see they have banked my cheque for £10. Is this their ploy to avoid extra charges being claimed?
Should I expect to receive the details tomorrow, and if not can I complain to anybody about them not sticking to the 40 day rule?

Sorry for resurrecting this rather old thread but I thought people may be interested in my experiences regarding a recent complaint I made to the Information Commissioners Office (ICO)
Initial complaint made about 9 months ago.
3 months after filing the complaint, I received an acknowledgement from the ICO, apologising for the delay in responding due to heavy workload, and asking a couple of questions in an attempt to clarify the complaint. I supplied the information shortly thereafter in a letter to them.
(Actually it was probably about 4 weeks as they sent the initial letter to the wrong address and it took over 3 weeks for it to be forwarded to my correct address)
Recently, I got another letter from the ICO (this time with the correct address on). This letter, some 9 months after my initial complaint, again apologises for the delay, again citing heavy workload issues.
The letter says that, based solely on the information provided by myself (so they haven't even contacted the errant party yet) that they are upholding my complaint.
The letter goes onto say they will now contact the errant party and explain their error and attempt to educate them as to their obligations under the DPA. If the other party contest this provisional decision, then they will contact me again.
Otherwise they thank me for bringing this to their attention and the complaint will be considered closed; compensation is not something they are empowered to award.

Like others, I've had no response to my SAR from Barclays, in over 40 days.
Rather than waste a stamp (+ recorded delivery charges) I sent a complaint/reminder to them online, by sending an email via the 'Contact Us' option, on the top-right corner of their homepage.
I received an automated confirmation of the complaint straight away. Which stated that, for security reasons, they will respond in writing, in five working days.
I'll wait and see...0
