40 days and no info/statements

    well i sent all letters by recorded delivery with a £10 postal order. i have recieved "some " statement from capital one but i know its not a complete copy .
    i just cant get statments from three catologue companys they say they dont keep the data also one went to debt recovery.

    i feel like just giving up !!!

    That banks do everything they can to make people give up or even scare people so they dont have to pay out, dont let them!

    i think it normally takes about 28 working days for your statements to come, after that just ring them asking why u haven't got them yet, thats what i did, i rang them every day after, i asked to talk to a manager and she sent my statements that day

    i have spoken to grattan who only gave me statements from 29/3/2001-27/7/2001 thay say they have no more data on me because it went to eos solution (debt recovery) they adviced me to ring them .

    i have just rang eos solution who tell me they cannot give me statements beacuse the account is closed.

    WHAT DO I DO NOW GIVE UP ????
  • im having problems too, HALIFAX delayed sending out my statements til they got the freeze off OFCOM and OFT..

    they even sent me a letter claiming that due to high volumes of requests, id have to wait 40 days for my statements, then sent the statements out WITH the letter about the charge reclaim freeze..

    im thinking of filing a complaint...

    that 2.5k would get me out of a hell of a lot of worry..

    The banks have to send you your list of charges for the last 6 years, but they also have 40 days to do that, so as long as you receive them within 40 days, you haven't really got cause for complain.

  • I have been trying since April to get my copy statements out of the Natwest bank so that I can lodge a claim. I must admit that I did not initially send the £10 fee but 45 days ago I sent another request together with the £10 fee. The letter I sent was the one giving them 40 days to respond. They are still ignoring me. As I believe it is a legal requirement for them to send me the statements even while the court case is going on What should be my next step. I believe I am owed about £2500. Thanks Terry

    Lodge a formal complaint with the Information Commissioners Office assuming that you did make the request under the Data Protection Act.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • hi folks, weeks ago i decided to take the plunge, and attempt to re-claim my charges from the bank, i used the tenplate letter, filled in my details, as i have 3 accounts, i enclosed a postal order for £30.00, requesting copies of my charges from all accounts, i sent it recorded delivery to my bank, i should have had a response by now today 28th August 2007, i've received nothing from them, the 40 days heve gone, what can i do?

    Report to the Information Commissioner. Btw, a cheque for £10 per bank would have been enough as it is an information on your person.

  • Hello all,

    A quick question about bank charges. About a month before the FSA put a hold on these cases I contacted Barclays about an account I held with them a few years ago(now closed). I managed to get the account number after ringing them and wrote to them with the template letter asking for a list of charges on the account including the £10 fee.

    I've had no reply from them since and can prove they recieved and signed for the letter. A few weeks later the FSA put the hold on reclaiming cases and I've still heard nothing.

    Any advice as to what I should do now would be greatly appreciated. Are they still obliged to provide the record of charges even though the claims are on hold?
