i paid £10 for my bank statements awhile back, i have asked for the list of all charges, so should i write again and ask for the list of charges again and state a deadline for everything to be settled,0

The bank has 40 days to comply with your request for information/statements, if they don't respond in this time you need to report to the ICO. http://www.ico.gov.uk/0

I used the template on the website to start the ball rolling by asking for my total charges in the last 6 years. That was the 10th May, I received a letter from them saying they were really busy and they would respond within the 40 days. They didn't, despite another letter I sent on the 27th June!
As they haven't written to inform me of total charges sustained, can I still take it to Court or the Financial Ombudsman!? I am assuming not because I have no idea how much I am claiming!
Please help me!

I had a debt with Sainsburys bank which has now been repaid but I thought I would request the last 6 years statement to see if I had been charged any late payment fees etc. I requested the statements on 6th March 2007 and enclosed a cheque for £10.00 in respect of the maximum statutory charge and requested a response within 40 days.
No response received although my cheque had been cleared through the banking system. I wrote again on 24th April 2007 advising that I was still awaiting the information and requested a reply within the next 14 days.
I received a letter dated 30th April 2007 from Bank of Scotland who presumably administer Sainsburys debts advising me that the information requested had been ordered and would be sent direct to me.
I wrote again on 14th June 2007 advising that no information had been received and requested a response within 14 days. I have still not heard from them can anyone please advise me of what to do next. They have taken my money but not delivered the goods.

To clarify, the 40 days is taken from when the bank is deemed to have received your letter and cheque and is 40 straight days and not 40 working days.
If you have had no reply from your bank regarding your SAR request within their 40 day deadline you can try sending this letter by Rex_Mundi to your bank.

You can also and indeed should report the bank to the Information Commission, however as they are very busy handling these complaints they are sending out the complaints to the bank in batches on a monthly basis.

If you bank with Lloyds and HSBC you can download your statements online. Best advice is to camp on the doorstep of your local branch and/or phone HO/Customer Services/local branch daily until they get sick of you.

Hi ALl,
I requested my bank statements by telephone for the last 6 years from the Halifax in order to reclaim my bank charges- I weas told I will be sent a list of charges as opposed to statements.
This was on the 22nd May 2007. They then wrote to me thanking me for my request on the 28th May annd they could confirm I would recieve the info no later than 40 days from the date they recieved my request ( 22nd May).
Todays date is the 19th July 2007 which makes that 59 days. Even if you only class it as working days it is still 43.
I have just phoned the Halifax to chase this up and was read a written statement that the employees have been told to read to customers basically along the lines of ' As we have been inundated with requests it make take longer' I said I appreciate this but not 19 days longer ! She told me she was not allowed to send any correspondence to them or any type of note to inform them I was chasing it up as this would only delay the process !!
Any ideas on what to do? I had a look at the ICO website but this only reffered to credit card charges.
I have successfully just claimed £754 back from HSBC after asking for £1075 and were able to access my statements immediatley online.0 -
i am in exactly the same boat and just got off the phone to bank of scotland. they said that they have emailed the some dept and they are putting my case as a matter of urgency as i should have received something by now but that i should hear something within the next 5-6 days
i got the same , " we are currently recieving a high demand for these type of claims" response and i have been waiting for around the same time as you.
i think its just a case of phoning again and kicking up a bit of a stink 'til you get the response you want.
they even tried to blame the postal service at first!0 -
i have written to my bank asking for the 6 years of bank statements they have had 2 months now i get letters saying sorry but because of influx of letters it is taking longer to get them sent out, i sent the letters same day as my other letter to another bank and have already received them in aloted time period so why is it taking other bank so long, is there anything i can do now to speed them up0

Hi,
I am currently trying to sort out my ex-wifes bank reclaim.
She is with Lloyds, and I sent the £10 fee and request over four/five months ago.
After 40 working days, they sent a letter saying that she could not claim the money back as the fees were for overdraft charges and returned cheques, but they would send the details anyway within five days.
After four months, they have still not sent them.
We have rung the number for this service and we can never get through, and when it tells you to leave your name and address, it says the message box is full and to ring back later - we've been ringing for months!!!
I have spoken on her behalf to other departments several times and they have said they will personally arrange for someone to ring us - nothing.
I have left complaints which they have on the system, still nothing!
Can someone advise what to do next?
Also, as the letter explained, is she really not entitled to a rebate because it is o/d fees and returned cheque fees?
