40 days and no info/statements

    I've asked my bank for my statments a few weeks ago but nothing has come through the post.

    Is it a good idea to wait or to call them again??

    The banks are swamped with requests. They are required to send them to you within 40 days though, you could send them a letter nearer that date and threaten them with the Information Commissioner.

    HI All,
    Just to let you know, have filled in complaint form as FOS have said they will take it up for me, hope I get lucky this time!! Will keep you informed as to progress - how can Abbey get away with non-compliance for so long??

  • The Halifax Data protection office initially confirmed receipt and said they were busy and would get round to it blah, blah, blah...
    Anyway after 40 days I phoned and was left hanging on for 30 mins till I gave up.
    So I wrote reminder stating their legal requirements and asking them to reply by return - 10 days later still nothing.
    I'm sending a complaint to the ICO ( Information Commissioner) using their complaints form but it looks like it might take an age for them to do anything. So..

    MY QUESTION IS:
    What to do when the data Protection Office seem content to ignore your reminder, leave you hanging on the phone?
    Anyone any ideas?

    Nothing you can do cept wait until IFO contact them.

    I had same problem with Halifax but got them in the end when the IFO contacted them.

    You should get all your statements now within 2 weeks :)

    hi, new here and looking for advice...
    i wrote to my back 2 weeks ago asking for a list of all the bank charges as i intended to claim them back,i recived a letter to say that they are considering it and will be able to respond within 6-7 wks if not sooner, i didnt get my list of charges,are they trying to fob me of ?? then wks later they say no, should i wait or contact the bank, i suppose im afraid to rock the boat. any advice appreciated...
  • You need to ask for details of all default charges applied to you over the last 6 years and request the info under the data protection act, its your right and the bank has 40 days to provide it, you will need to send 10 quid to them to cover it, and send it recorded delivery, martin has templates letters you can use.

    If they dont send them to you within 40 days you complain to the information commisioner, and keep hassling them until you do get the info, dont even think of claiming without your statements ( I Did ) and its a pain in the !!!, best get the info then claim.

  • Ring them and tell them you Want a full list as asked for in your letter of ALL default charges for the last 6 years..tell them they have another 5 days in which to comply..which i think is fair..did you send the 10.00 to cover the costs..if not do so..hopefully you will get the list you require to go to the next stage..letter 2.. DO NOT give up no matter what the bank building society say or threaten..DON'T give in...i got all mine back even tho i got to the court stage Nationwide paid up before the court date...stick to Your time limit..do not give in to theirs....follows the letters on here and fingers crossed you to will have a nice little sum put in your bank to...xx good luck..it can and has been done xx
