40 days and no info/statements

    You cannot claim the interest on overdraft charges but charges for returned cheques and DD's you can. Write to them again telling them you are now refering the matter to the Financial Ombudsman and do it.

    The Information Commisioner has made it quite clear that failure to supply documents under section 7 of the DPA is a criminal offence and has advised that these claim should be dealt with via the courts.

    Go to the CAG website and they will advise how to force the bank to give you the information you need.

    If the claim for the repayment of charges goes all the way to court, then you will be entitled, at the courts discretion, to s.69 intrest at the rate of 8% on ALL charges.

    I have now written to Lloyds Bank twice since 13th April 2007 requesting a statement of charges.

    What do I do if they dont reply?

    The address I used was.......

    That is the correct address.

    Apparently they are taking longer than usual to deal with SARs, as so money of us are now writing to reclaim our charges!! ;) .

    They have gone over the required timescale for you though - have they cashed your £10 cheque/postal order? Also, did you send your letters recorded delivery?

    Yes I sent the £10 cheque but no they havent cashed it. I have sent both this and the reminder letter by recorded post.

    Do I have to take it somewhere else now?

    Hi,

    Have you checked that it has been signed for?

    If they have signed for it and not actioned it you can report them and them I'm not sure. Going on what I can remember reading somewhere else, you can report them and then I think there is something else you do.

    I will have a look later to find the post I saw, as it specifically tells you what to do in that situation - sorry, my memory is failing me!

    It's in the reclaim your bank charges forum - same as this one.

    In the search box type in "SAR time limit" and it should bring up some posts, one of them being "40 days up and nothing".

    Hi

    Is there anyone out there who can give me some advice on this please!!!
    I have a halifax bank Account. I sent the first letter requesting my past 6 yrs statements in April 07 along with a cheque for £10 to cover the fee for this. Halifax cashed the cheque 03 May. To date I have not received these statements. I received a reply in June stating that this was in hand and have heard nothing since. I reported them to the Ombudsman for cashing the money and not responding within the 40 days timescale and sent Halifax a copy of the breach forms I filled in. I have received a letter from the Ombudsman to the effect that they are extremely busy, but will look into the matter as soon as they can. I have heard nothing from Halifax. Is there anything I can do to speed up getting the statements? Surely there is a law against a company taking money as they have done with the fee and request for statements within 40 days and not giving a service?? Any help would be appreciated!
