40 days and no info/statements

    Am trying to reclaim my credit card charges and asked Lloyds to send me my statements to me enclosing a cheque for the ten pound they charge for it. 40 days later they sent me through 4 monthly statements and nothing else. I telephoned them and asked for all the other statements which I had requested. The women stated they sent me all they could and that unfortunately no other statements where available. I informed her that I would be going to the Information Commisioner if I did not get the statements and she said she was sorry but unfortunately they could not locate the statements. I went through the Lloyds TSB complaints procedure for perhaps the 50th time and they gave me £50 compensation and still didn't give the statements. Went to the information commisioner and made my case to them. They went back to Lloyds and told them to provide me with the statements after a lenghty wait only for me and the information commisioner to be told that they have lost all the information and statements from that card. Since this happened I haven't heard a whisper from the information commisioner and am bewildered as to what to do in regards to reclaiming my charges. Can I just select a figure at random (say 5 billion (I feel they owe me that much))and go through the reclaiming procedure or shall I just wait and see what the commisioner is going to do.?
  • hi all i asked my bank a couple of weeks ago now to send me my statements and they debited my £10 but havent recieved anything yet do you know how long it generally takes.

    also im not sure where to look up about whats going on with this court case or when it is etc, could someone please tell me. thankyou

    They've got 40 days. They WILL take that long.

    I think the court case hearing may have ended last Friday, but it will take several months for the judgement to be reached. All claims cases are frozen until that time I believe.

  • ok thankyou, i knew claims were frozen until judgement reached but when i get my statements should i still send the first letter in anyway or wiat until judgement reached, thankyou

    Lloyds have been told to send me my credit card statements by the information commissioner and to do so within ten working days (this was agreed by me and the information commissioner) they are now 4 days over due (not including the weekend) I spoke to the commissioner who joined me in a conference call to Lloyds TSB (god bless bosses who take time off when you need it) and after twenty minutes on hold while the operative got a team leader to talk to us we were informed that there was a massive back log of requests and that I will have to wait. The woman from the commission told me afterwards to send a letter to lloyds telling them that I would be charging them £20 a day since the last time I received the statements (January 3rd 2008) as a penalty for failing to provide the service I had paid for as Lloyds would not hesitate to charge me.

    Now can I do this as I feel she is correct that I have paid for a service they have completely failed to deliver. You thoughts please.

    Lloyds TSB should be able to send this information within the specified timeframe. Not sure how much success you'll have with invoicing them. Do you have what the Information Commissioner said in writing? If nothing else, it might hurry them up.

    Some people have taken the banks to court for not providing data under the act. I'll fish out the info for you.

  • sorry but this is exactly what people are claiming form the banks - the £20 in no way reflects your true loss by them failing to produce the information. It would be morally as well as possibly legally dubious to do this.
